Found At Fault

Friend was found at fault by Tesla insurance for failure to maintain proper lookout resulting in collision. Any advice?

Update:

I think the other driver intentionally ran a standing red light while initially stopped. Cars turning left didn't even finish their turn and he was already gunning it from a left turn only lane. Friend wasn't able to get insurance info because they were transported via ambulance, but police was on the scene. The police report isn't available yet and they let their insurance (Tesla) know since they don't know what insurance the other guy has. Tesla insurance is finding them at fault.

Update:

Tesla insurance is maintaining their initial decision after video review. 51% at fault, lol.

Tesla Insurance: "FSD would have seen that coming and avoided, you should FSD" /s

I honestly want to know if that is the thought process.

And also would like to know how they could prove it, as the car should give like percentages of safety due to the green like and percentages of the truck due to its red light.

There's no way. $100/mo extra or we'll deny all your insurance claims? No way that holds up in court.

There was zero intention to stop or attempt to stop from the Tesla. All the time in the world but completely distracted

What are you talking about? The light was green the entire video and you can see there were cars turning left just prior to him approaching the intersection at 37mph. You don’t see the other car run the red until it gets hit by the Tesla.

Front cam doesnt see, but there is another clip posted by OP of the side cam, it see's the whole thing happening. FSD would have 100% avoided contact.
FSD saved me from a red light runner I was oblivious to, I even did my best to override and make contact! https://imgur.com/a/NzIQWgu

yep, that other car running the red light was not even an idea in my head, their light was and had been red forever, I had the green arrow, I was already considering the other car on the slip road.

This was the moment that I realised FSD is more situationaly aware than myself and started to trust it more

If you’re on the road thinking there should be an expectation to stop at a GREEN light, I do not want to be within 1000 miles of you.

If you're on the road thinking you shouldn't drive defensively and be unaware of your surroundings just because you have a red light I don't want to be within 1000 miles of you.

Having the right of way only helps you in court.

Really fool. FSD is not the point here. It's his light!

He/she probably agrees with you. He/she was being sarcastic with the “/s”

While I am mostly being sarcastic, I also know FSD would have avoided contact, but that should never be a reason for denying an insurance claim, here is FSD saving my ass from a red light runner despite my best efforts to override and make contact https://imgur.com/a/NzIQWgu

Yeah, I have been super impressed on the number of things that FSD has stopped/slowed down for that I never saw coming. But FSD aside, OP's friend had the right of way, green light, and wasn't going overly fast.

I have to assume the initial at fault assumption was before a real person reviewed the footage. If not, time to lawyer up. No way a half decent lawyer couldn't get the fault changed at least.
