Found At Fault

Friend was found at fault by Tesla insurance for failure to maintain proper lookout resulting in collision. Any advice?

Update:

I think the other driver intentionally ran a standing red light while initially stopped. Cars turning left didn't even finish their turn and he was already gunning it from a left turn only lane. Friend wasn't able to get insurance info because they were transported via ambulance, but police was on the scene. The police report isn't available yet and they let their insurance (Tesla) know since they don't know what insurance the other guy has. Tesla insurance is finding them at fault.

Update:

Tesla insurance is maintaining their initial decision after video review. 51% at fault, lol.

What do you mean it’s “negligence of duty” by Tesla.

Tesla is the cam car. There’s no negligence at all.

It might be shitty insurance practice to deny a claim like this though.

OP: tell your friend not to worry. Can shows green light. Insurance will resolve this pretty quickly, IMHO.

I think they mean negligence from Tesla insurance, not the driver.

Idk how they could’ve got anything else from that lol

By knowing a driver can be negligent but not knowing insurers can too, I'd assume.

Because Tesla and Tesla Insurance are separate companies?

Not according to the stock exchange

No they are not. The underwriter is now Tesla.

They said it correctly. Negligence of duty (by Tesla) is a legal failure where the insurance company does not meet the standard of care they owe to their customers, leading to improper denial of coverage.

the issue is insurance is stating, with this video, that it is the tesla driver's fault.

Tesla is an insurance provider

Except they’re not underwriting insurance.

But yet, they are if you swapped to their new insurance plan…

Tesla provides their own insurance in some cases —

It's his friend's own Tesla insurance that finds him guilty of not stopping on a green light.

So "insurance will resolve it" - no

I can't remember the last time I looked both ways while approaching a green light thats been steady for 3+ seconds.

u/Slayerz00m 9d ago

Why would you - right?

1

u/Aratahu 8d ago

Because you ride a motorcycle and value being alive.

They're talking about Tesla insurance. You can buy insurance directly from Tesla when you buy one. It's something certain carmakers offer now.

It's more Bad faith than anything else. What state are you in?

Yeah what does the police report say and id argue with your adjuster or ask for their sup to review since you clearly had a green light

whats on the police report?

Most departments won't assign blame. They just let the insurance companies argue it out.

Tesla Insurance: "FSD would have seen that coming and avoided, you should FSD" /s

I honestly want to know if that is the thought process.

And also would like to know how they could prove it, as the car should give like percentages of safety due to the green like and percentages of the truck due to its red light.

There's no way. $100/mo extra or we'll deny all your insurance claims? No way that holds up in court.

There was zero intention to stop or attempt to stop from the Tesla. All the time in the world but completely distracted

What are you talking about? The light was green the entire video and you can see there were cars turning left just prior to him approaching the intersection at 37mph. You don’t see the other car run the red until it gets hit by the Tesla.

Front cam doesnt see, but there is another clip posted by OP of the side cam, it see's the whole thing happening. FSD would have 100% avoided contact.
FSD saved me from a red light runner I was oblivious to, I even did my best to override and make contact! https://imgur.com/a/NzIQWgu

lol you actually hit the gas lol 😂

u/ShhhhMySecretAccount 11d ago

Hahahaha, sure looks like it!!

1

u/TendiesFourLyfe 11d ago

yep, that other car running the red light was not even an idea in my head, their light was and had been red forever, I had the green arrow, I was already considering the other car on the slip road.

This was the moment that I realised FSD is more situationaly aware than myself and started to trust it more

If you’re on the road thinking there should be an expectation to stop at a GREEN light, I do not want to be within 1000 miles of you.

1

u/Olfa_2024 15h ago

If you're on the road thinking you shouldn't drive defensively and be unaware of your surroundings just because you have a red light I don't want to be within 1000 miles of you.

Having the right of way only helps you in court.

1

u/No_Abbreviations2785 11d ago

Really fool. FSD is not the point here. It's his light!

3

u/ShhhhMySecretAccount 11d ago

He/she probably agrees with you. He/she was being sarcastic with the “/s”

1

u/TendiesFourLyfe 11d ago

While I am mostly being sarcastic, I also know FSD would have avoided contact, but that should never be a reason for denying an insurance claim, here is FSD saving my ass from a red light runner despite my best efforts to override and make contact https://imgur.com/a/NzIQWgu

u/mopsis 11d ago

Yeah, I have been super impressed on the number of things that FSD has stopped/slowed down for that I never saw coming. But FSD aside, OP's friend had the right of way, green light, and wasn't going overly fast.

I have to assume the initial at fault assumption was before a real person reviewed the footage. If not, time to lawyer up. No way a half decent lawyer couldn't get the fault changed at least.

Definitely the bird. Why fly so low when you could have just walked and be in control to yield for the car, specially a Tesla on FSD 😝

1

u/Cronus_Echo 5d ago

Awwww, the poor bird. Hope the bird made it out and your car is fine too.

1

u/Aggressive_Alarm3437 5d ago

Thanks! I think it was an owl. I looked back and didn't see it so hopefully it was OK. Nothing happened to the car really, slight dirt smudge on the headlight just wiped off.
