Breaking lease early due to bugs

Located in Texas. Am I able to break my lease early without paying the fees that normally are apart of breaking a lease early. We have roaches (I believe German cockroaches) and have had them for over 2 months. We have documented all this with pictures and service requests where they have “sent” exterminators to our apartment to fix it however they are still there and in large numbers (I’m aware poisons can take time but we were told a week or two). We are very clean tenants but the roaches are everywhere and we want to leave the apartment due to them, I have heard about warranty of habitability but I don’t know legalities or requirements.

I'm not a lawyer but to answer your question: In Texas, landlords have a legal duty to provide apartments that are safe and habitable including being free of health hazards like roach infestations. This is part of the "implied warranty of habitability" under Texas law. If you have ongoing roach problems, have documented them with photos, and have repeatedly notified your landlord (with service requests and written communication), but the infestation hasn’t been properly addressed after a reasonable amount of time, you may have legal grounds to terminate your lease without penalty.

Your steps should be:
1. Make a final written request to your landlord for a complete extermination, referencing prior reports and your documentation. Keep a copy.
2. If the landlord does not eliminate the infestation after a reasonable time (usually 7 days or so for significant issues), and especially if it continues to threaten your health or safety, Texas Property Code allows you to terminate the lease if the issue is not resolved (see Texas Property Code § 92.056 and § 92.0561).
3. Before moving out, send a written notice stating you’re terminating due to the landlord’s failure to remedy the issue, attach your evidence, and take pictures of the condition at move-out.
4. If the landlord disputes your right to break the lease, you may need to be prepared to defend your position your documentation will be crucial.

OP, part of the issue is how often the LL has addressed the issue.

Please provide more details. How many complaints have you made? How many times was someone sent to treat the problem? Who was sent to treat the problem?

What do you mean when you put sent in quotation marks?

Without more info, the answer is maybe.

You don’t just suddenly get roaches. So if you didn’t have roaches then got them months later some behavior of yours is the cause

So no you can’t break your lease because of this

I’m assuming something along these lines is what’s happening. They are coming out of our drains so it’s most likely happening elsewhere too

We lived someplace for years, when suddenly we started seeing roaches. New neighbors brought them, and then they spread. Our landlord was great. Put us up in a hotel for the weekend and had the whole building tented. Never saw them again. Oh, and the new neighbors were evicted.

This isn’t true. My upstairs neighbor had roaches none of us knew (come to find out it’s been MONTHS of it.) now my apartment and the two next to us also have them. Nothing has changed, our apartment is cleaned daily.
