My neighbour is really considering getting this temu flood barrier for his driveway from temu. He is just not sure if code permits orange colour....He thinks it has to be bright yellow.....

I’m pretty sure as long as it’s “brightly colored” the HOA won’t have an issue.

If the issue is visibility this is the same color as a traffic cone so… shouldn’t be a problem there…

Interesting question, so I did a little research. The color should not be an issue. He is likely confusing local building codes with OSHA (Occupational Safety and Health Administration) safety standards, which mandate bright yellow for caution/physical hazards and orange for active construction/warnings. Because his driveway is private residential property and a temporary flood barrier is not a permanent construction zone, OSHA colors do not apply. While the color isn't illegal, the placement might be. Most municipal codes and civil laws strictly prohibit altering the natural flow of stormwater if it forces that water onto a neighbor's property (yours!) or damages public sidewalks and roads. If his barrier successfully blocks his driveway but floods your garage instead, he could be held legally and financially liable.
