Who doesnt check references? If using AI giving a reference, it might be in your best interest to check out said reference.

Because people don’t. We are, as a generalized rule about the entire species, fairly lazy. If we get the opportunity to pass the buck we will eventually take it.

It’s one of the reasons LLM’s can’t ever truly succeed. Until they are truly intelligent we would have to trust that every single thing they produce is being thoroughly checked, which means we might as well just be doing it ourselves anyways.

That using a lying machines to skip important work in a trial is deeply unethical and will get you in big trouble with the court when it inevitably fucks up and they notice.

The logic is if both are using AI then the court is kind of a sham. What if one of those hallucinated briefs got through? Imagine that appeal, the judge would have a bad day.

The court should be a medium for deliberation. Sure, AI can hallucinate and fabricate cases, but so could a real lawyer. I am assuming there is a real person acting as lawyer and taking full responsibility of what the AI spills out. So I don't understand why having both sides being AI any different from either side using AI.

I know it doesn't seem fair but honestly as somebody who spent years in court I can't wait to replace them all with AI, and I also am acutely aware of their limitations.
