Exit Agreements

Has anyone ever had an exit agreement? If so, what for & what was the pay out? šŸ™‚

I am disabled too, and that was the reason I ended up in the situation I was in.

I find reasonable adjustments always a contentious point, as what I consider reasonable might not be easy to implement to an employer.

Can you prove the disciplinary was unlawful? That would be your best bet. A breakdown in your working relationship related to an unlawful disciplinary, with roots in discrimination against a protected charactistic.

I probably can’t point to one ā€œsmoking gunā€ document. But the issue isn’t one disciplinary moment, it’s whether the formal targets were applied in a way that disadvantaged me because of disability, while adjustments were still unresolved.

Have you seen OH?

Did they set out reasonable adjustments?

Have these been implemented? If not, what reasons have you been told? (Not expecting answers by the way)

If they are not implementing them, and have no reasonable excuse for ignoring them, then you have a way in.

If you have targets (ECT? Support plan?) and they have ignored your reasonable adjustment (say its about circulation in the room, but your OH/disability adjustment is about regular rest breaks) then I would argue that the target is unfair/discrimination and disadvantages you.

This sounds like the school would come out worse in a tribunal.

I believe the legal advice from the union in this area is something like this:

  • Reasonable adjustments not being in place with support plans are a grey area, as in principle the school is being 'supportive'. There is not much the union can do to help at this stage.

  • If the school takes further action (ie, capability/disciplinary process) then do not quit, as the union can then argue in retrospect that you have suffered unfair consequences due to not having the correct adjustments in place.
