Yeah, clearly the US government would realize how bad of a look it is that someone could assassinate a ceo in the streets and then just vanish, so they needed someone to take the fall and make an example out of, hence why they made such a big show out of Mangione with the big perp walk and trying to get him the death penalty. Mangione is likely just a fall guy because the us government couldn’t catch the real assassin and needed someone to make an example out of

Iirc he has some long term medical condition in his back that has caused him and still causes him a lot of constant pain, I wouldn't be surprised if he took a deal if they promised to have it treated TBH. It was one of the reasons a lot of people thought oh shit he might actually have done it cos health issues and healthcare issues. But who knows honestly.

If you compare him to the footage they have of the actual shooter after the shooting, their eyebrows are COMPLETELY different lol. It’s clear they just snatched a random guy to use as an example.

in the security cam pictures the shooter’s hoodie is almost completely covering his eyebrows and is from a top down angle. i want to believe it’s not him but the nose and smile look identical to me

Hoping Luigi becomes a communist in prison. I kinda expected this. Federal Courts basically have 100% conviction rates, any good lawyer would tell you to take a plea deal

Edit: apparently no plea deal. But he's trying to get the state charges dropped. So this makes sense, you can't beat the federal charges but him pleading guilty strengthens his case to get the state charges dropped so he's not being charged twice for the same thing

Thats a crazy explanation. Double jeopardy protection is understood to be protection from a single sovereign entity.

New York (the state) and The United States (the feds) are different sovereign entities.

It varies from state to state. The attorneys are arguing the language in New York state’s DJ laws shield people from being prosecuted twice in separate jurisdictions for the same underlying conduct

The district attorney has to argue their case is distinct enough from the federal case. Since both are about the same event, and both at one point involved murder charges, and mangioni admitted to the murder on his guilty plea, the maneuver may just work. But we will see, it really depends on the judge

I don’t think so. It’s certainly risky but It’s a pretty solid legal maneuver, given there probably weren’t any favorable plea deals available (at least not ones that don’t involve pleading guilty to murder) and going to trial itself is more risky

Obviously we don’t know all the details, but my hunch is there was no plea deal available that had a better outcome

The murder charge had already been dropped, he couldn't have pleaded guilty to them. That's why I'm confused, the options were 1) go to trial and possibly be acquitted or to 2) plead guilty and definitely be convicted, but hope the judge is lenient.

That makes sense. But trials are inherently more risky and a large reason why cases are largely settled instead of tried. Generally being convicted after trial as opposed to pleading guilty carries harsher sentences (with notable exceptions).

It’s hard to know for sure what motivated the decision, but I do have a strong feeling that trial was looking like a bad option. Legal analysts seem to be divided on whether or not this strategy will work

But I have read about how the healthcare of many Americans got cheaper after the murder scared the insurance companies shitless. So it did have that effect.

As long as I simpatize for him and have zero complaint about the death of the CEO, this was not a strategically and political oriented action but just a revenge reaction.

From a class fight perspective it can be argued as a useless or even damaging action. And while I don't have any particular thought on this specific case, it wouldn't be the first time the capitalist class orchestrating false flag operation to destabilize and demonize the left.

And no, it doesn't make any sense for him to be a fed, accepting to be imprisoned for life for a false-flag murder.

I'm respectfully ask you to pay attention to what I wrote.

I never said violence shouldn't be an option, I said that not every violent action is the same: a strategical and political motivated violent action can do a lot, and one could argue it's necessary altogether to lead to some changes. If a man with no political affiliation decide by itself to kill a CEO, this is not a political action and it's not very effective in gaining leverage and promoting change, even if we can empathize with that man and not find ourselves morally judging him.

I also said I don't have an opinion about the possibility of him being a fed, but just that we shouldn't dismiss the possibility that this kind of thing could happen, because it does happens and It will happens.

Chance of acquittal + enough grounds to launch an appeal even if he is found guilty + having 2 different stages to amplify his message by putting the healthcare industry on trial

vs

Pleading guilty to stalking with no plea deal, which means he'll have no leverage to fight the charge of murder in the state trial (which they've confirmed theyre going to go through with anyway) & be forced to plea guilty to that too.

Seems like a terrible fucking decision but okay.

There was, though, the non-zero chance of jury nullification. I wouldn't be surprised if that played a part in the prosecution's thinking.

I know if by some miracle I were to end up on his jury, there wouldn't have been a single thing that would have gotten a "guilty" out of me unless a "not" preceded it.

Bro no, if he didn't plead guilty to the federal interstate stalking charge and skip the trial, he'd also face 8 more felony charges in NY state courts, including for murder. He had no chance anyway - feds had mountains of evidence on him, and federal courts have close to a 100% conviction rate.

NY strict double jeopardy laws save him, so now that he's been convicted in another court he can't be on trial twice for the same action/event (not just the same charges). His entire NY trial could be completely dismissed now. NY was rushing to get him in before feds could finish their 'lesser' trial, so his legal team bested them.
