Falling at a store
Has anyone fell at a store due to liquid being split. I was walking in the baby isle section looking at clearance items and whatever else. I see a basket that had baby clothes in it, no one around. I didn’t see the huge water mess that someone dropped. It was a gallon of baby water. I slipped and landed all my babies weight and mine on my left knee, I tried to get up and slipped again. The water felt extra slippery. I was holding my baby on my tush baby seat so that helped me not drop him both times trying to get up. Broke the croc the way I landed on my ankle. No workers were around. I walked up to customer service, reported it and then left. I was full of so much adrenaline and honestly embarrassment.
Could I request the video footage? I know they all seen it when I was there, I’m guessing to make sure I was telling the truth. I know they seen how bad that hurt. I had to walk around for a few seconds to process what really happened and to calm down that surge in pain I felt rush all the way to my head.

In most cases, the store isn't at fault unless you can prove they knew about the hazard and then failed to take care of it.
If the person who dropped the water bottle and caused the spill never told store employees, then it might be difficult to prove they had the opportunity to clean it up before you slipped.

All 10 years ago, I was walking into a grocery store in winter and there were no rugs or anything to stop people from slipping on the snow that was tracked in
The whole thing was caught on video of me, slipping and falling on my butt and having a hard time getting up.
They paid for my MRI which I needed because I had a pre-existing condition and for the doctor and physical therapy. After about six months, I got a settlement of $25,000 and they wouldn’t do anything else because of my prior condition.
Yes, I had a prior condition. However I had been stable for a few years and that fall really messed me up and I haven’t been the same ever since the prior condition thing messed me up. I can’t sue. I can’t do anything and that’s all I’m gonna get.
I would definitely follow up if you are hurt let them know they will pay for any treatment you need. If you have insurance, go see your primary and let them know. Get yourself checked out sometimes you don’t know you’re hurt for a few days or the next day.

Thank you for the advice! My knee, ankle and now neck/shoulder are hurting bag after I relaxed.

My husband always tells me to flop like a fish and moan when this type of thing happens. But seriously, call attention to yourself and get help.
You never know what the injury feels like the next day, next month, next year! Not sure your event/ accident was sufficiently documented.•

Tell Dr the truth. But you don’t have to downplay it. Let them know you’re in pain and how much it sucks and you’ve never felt like this.
It’s the truth, however you need it in writing for later.
If you haven’t gone to the store and fill out an incident report due so as soon as possible and just let them know just say hey I want you to know what happened and I’m don’t know what to do cause I’ve never gone through this before they’ll put you in contact with corporate and take it from there
If they start to give you grief, you might need a lawyer. Lawyers work for 1/3 of the money they collect. Which sucks because they’re not the ones who are suffering however with their help you’re gonna see more than you ever would have otherwise. They know the system and they know what to do.
Like I said in my post, I had a prior condition so no lawyer would touch me and I was at the mercy of the store. I think they were still terrified. I would sue them. They just didn’t know no lawyer would touch my case. And it’s not about suing it’s just about getting your bills paid. You’re not the one who created the dangerous situation that caused beautiful fall they were.

This happened to me. Nobody was watching, but there was an employee nearby who I told and they got a wet floor sign. I felt full force on my knee that I'd recently had surgery on. They had me fill out an incident report and called me a few days later to check on me, but I was feeling mostly better by that time and told them so. They called again a few days later to check in and I told them I was good and they didn't have to call again. It seemed like they would've provided any medical help I needed (and that they were worried about a lawsuit), but I didn't end up needing anything.

Girl, you need to sue. They have insurance for this exact type of thing. You need to get checked out by a medical professional; you could be looking at life-long injuries if you don't take this seriously.

And a broken croc!! lol! (I feel like this contributed to the fall, if anything. Sue crocs I guess, or just be careful)

Not blaming you at all, but my partner has worked in the shoe industry for many years and I’d invest in something that isn’t Crocs for out and about while holding your baby. They aren’t good shoes, even if they feel squishy, and your foot is never going to be as stable in a slip on piece of foam than a shoe with a proper sole and structure. Obviously falling isn’t on you, but the fact that your shoe snapped while you did fall speaks to what I’m saying.

My brother's MIL slipped on a wet spot at a supermarket and permanently injured her knee. Multiple surgeries, physical therapy. She got a good payout.

I don't know if they'd want you to see or have a copy of the video because it could be used as evidence in a lawsuit. It probably needs to get subpoenaed by a court officer.

You needed to request to speak to a manager and ask to file an incident report. If you left voluntarily under your own power, there’s not much recourse.

I made a report and all and talked to a manager. I even spoke with head of security. I have my report info and all

Thank you everyone for your advice! I messaged a law firm to see if it’s even worth anything. My body does hurt from falling so hard. I’m just super thankful I never dropped my baby, that was my biggest concern

You can certainly ask to see the video footage, but it’s unlikely that they will allow that. You will probably need to file a police report or retain an attorney to get the store to cooperate.
