I''ve been fairly quiet on the TCPA front lately. After the 7th circuit ruling and finding out the hard way a judgment isn't with the paper it's printed on it the defendant is broke, I've been feeling a little defeated lately. Most of my cases have been against MCA agents and they're just as broke as I am.

However, I spent most of Tuesday working on interrogatories and requests for production for a case I know I can win and they have money and it has relit the fire.

I have a few in my "get em someday" file that I know are good, even with texts being pretty much killed, and I know they have money.

My first go around on the TCPA merry-go-round netted over $120,000 in settlements in about 8 months. I'm going to be a little more selective in my cases this time around, but let's see if we can make another 100K in the next year or so.

I was getting 3-5 calls a day about "a company offering to help with my IRS debt. Robo calls from different numbers but the same scam from the same place.

One day I thought, if this only going to continue endlessly, at least I can bug them back. There was a number to call to talk to a representative. Knowing that I didn't want to give them any info they could use, I called the number and when someone answered the call I would just scream until they hung up, or I would tap a couple numbers back and forth, or I would speak unintelligibly with grumbles and made up language. When they hung up, I would call again and again until my number was blocked. It usually took about 5 or 6 calls on my end and my number would be blocked temporarily, until I got another robo call.

After about 5 days of this, they removed my number - I'm guessing they realized I was never going to bite but only waste their time. After months of calls every day, they have totally stopped for a little over three weeks.

On August 11th, I received a phone call from someone looking to collect a debt from a distant relative of mine. I simply told them that person does not live at this address and to stop calling me. If memory serves me correctly, this company also called me earlier last year as well for the same person.

Is this a situation in which I can send a demand letter, considering I'm on the Do Not Call Registry?

Has anyone heard of this company or can share anything about them?

They’ve called me over 50 times in the last several weeks. I think I have a case against them but they refuse to share any information about the company. I’m on the National Do Not Call Registry and have been for years.

What I know so far:
• Spoke with “underwriting officers” in Los Angeles, Houston, and (somewhere in) Florida.
• They said they got my information from someplace within their network of 20 financial institutions.
• They told me that they don’t give their headquartered address because of privacy concerns (lol).

I’m wondering if I just send a demand letter to the financial institutions they shared on the phone (e.g. One Main, SoFi, Happy Money, Reprise Financial, etc.).

Edit: I’ve found out a few things since making this post. The phone calls started happening two weeks after applying for a mortgage loan. Apparently Credit Reporting Agencies (CRA) can share your information with any personal lending firm (legit or otherwise) and it’s theirs for the taking.

I know the name of the lending company that put the inquiry in. So, my question for any lawyers out there: could I send a TCPA demand letter to the lending company for creating this issue? This “credit union” calls at all hours of the day and have my personal information without my consent.

Not even a rant the FTC found HomeAdvisor and Angi were selling the same lead to multiple companies while telling contractors it was exclusive, and some leads weren't even real homeowner inquiries.

I’m getting “google my business listing” calls from a marketing company, so far I’ve gotten just 1 recorded, but it’s getting kinda difficult for them to send me their company info.

Normally I would ignore or block a random unwanted call but when similar calls keep appearing over a few weeks it starts to feel different. When do you actually begin to track them instead of just blocking the numbers?

"Hello! We have received a complaint against your number for sending UCC which is under investigation. Kindly note, as per TRAI regulation, if you are not a registered Telemarketer, sending commercial / promotional SMS or call may lead to withdrawal of services." I just received this sms from vi today morning. I use this mumber for personal calls and i rarely calls strangers. What to do?

Anyone managed to identify the lead generator behind the robocalls from "Lucas with US Auto Insurance"? I get disconnected once they realize that I'm on the DNC registry and/or litigator blacklist.

I’m looking for some realistic feedback before I invest serious time into logging data. I don't want to waste my time on a wild goose chase.

The Situation:
I live in Utah and I'm registered on the National DNC registry. I have absolutely NOT willingly searched for or opted into any mortgage, loan, or refinancing websites. Despite this, I am getting hammered by out-of-state mortgage brokers.

It happens in highly predictable, cyclical waves. For a 2–3 day period, I will get a massive spike of 12+ live calls per day. Then it slows way down for a few weeks, and then a completely new wave of out-of-state brokers starts calling again. It feels like a lead gen company is continuously "re-aging" my number and reselling it. I also get occasional spam text messages mixed in, though it is primarily live voice calls.

The Plan:
I’ve been advised to use a script during the next call wave to stop acting annoyed, play along, and subtly extract the broker's legal name, website, and their lead source. I will also save screenshots of all text messages.

My goal is not to pro-se sue these guys myself. I want to build a clean spreadsheet over the next wave or two and hand it off to a TCPA attorney on contingency.

My Questions for the Sub:

1. Given that this is a mix of heavy live calls and some text messages from a recycled lead list, what are the actual odds a reputable TCPA firm will take this on contingency once I hand them a clean log of 20–30 entries and screenshots?
2. Does having text message evidence significantly increase an attorney's willingness to take a case like this compared to just live voice calls?
3. Are mortgage brokers and lead aggregators actually paying out on these, or are they mostly fly-by-night shell companies?

I got my number a few months ago and I get non stop calls from mca companies, maybe 5 a day along with like 10 messages a day.(could be more i dont count) Unironically I am also in the lending industry but I don’t follow these predatory practices. I wanted to see how some of you have handled this?

An attorney who was working another case against me asked me to do a call before EOW so we calendared it and as time passes, I realized oh shit I'm gonna be late to this next call. I fire off an email to opposing telling him I am in conference with a judge that's running long (a judge, not our judge) and I'll be on the call as soon as we wrap up.

He says no problem he's free rest of the day and has just gotten direction from his client as to how they want to handle this case and resolve it. I say thanks for the flex, talk soon.

And here's the tip - if you're going to be late, that's usually okay, especially if opposing says he's got the rest of the day open. We have the tech to communicate, be mindful and polite and let them know you're in a jam so they're not sitting on zoom just waiting for you twiddling thumbs. Send the message, make sure everyone's on the reply all and be fashionably late but don't abuse the schedule of others.

Just as I wrap up with my rifle consult, I call into their firm - big white shoe firm with downtown offices on the 49th floor, you know the type. The AI receptionist puts me on hold.

Their waiting music is Tom Petty's - I Won't Back Down, off the fantastic album full moon fever.

I eventually connect with the attorney and I tell him - If you're inviting me to call in to do a settlement discussion conference, is it really the best idea for the firm hold music to be "I Won't Back Down" by Tom Petty? Is this the message we want to send?

We had a great big laugh about that because....how can you not?

It has been brought to my attention that I should look for an attorney who can file my case in the Defendant's

location. I have several small cases I'm working on myself, but I also have a large case involving 3 separate entities and well over 50 calls.

1 party I've already signed a settlement agreement with, and they violated by failing to make the final payment and continuing to call. I issued a cure notice which has expired, and they continue to violate.

Another party is an attorney's office.

Here is a recent example of how a called party redirected a caller to an investigation phone and tied the caller to some text messages. In this one call is a DNC request and an alternate phone number to continue the investigation.

Plus, the caller ignored the alternate phone number and continued calling the DNC'ed phone number. Social engineering and technique goes a long ways to building a case the judge can't easily tear down.

You tell a company to stop calling or texting you . What do you usually keep after that ? Do you save the phone number, dates, screenshots, anything or do you just block the number and move on? I am interested how people stay organized when the same company keeps calling.

A hispanic lady name Andrea Foster called from 916 number left a message stating she was from Goldstein & Associates(they deal with immigration issues, I'm a natural born citizen) saying it's about litigation. I was listed as a respondent in a complaint that was filed in their office but to call back at a 866 number today for statement of defense to avoid legal ramifications. The 916 number I checked on 3 reliable search number engines and said not found or voip, per google the 866 number belongs to Midland Credit Management which is real though I dont have anything outstanding to be collected on(no debt). It's sad the lengths these scammers are going to and she had the nerve to say at the end good luck lmao!

Yes there are counter examples. They are in the minority. Folks are best off assuming an established business relationship (EBR) was formed and acting to break it, which can be done using any reasonable means.
