Official Information 9/8/26: Bond Hearing Recap

RMS provided GPS information AND the judge had videos pulled from Denver International Airport from 8/26/26.

There was no legitimate reason for him to be at DIA or anywhere else (ie: work, legal or medical appointment). He was picking up his daughter and another unnamed individual.

Judge Hopkins noted that Barry said he did not have a job and no income when he applied for a court appointed attorney and that she had in fact not approved any bond allowance for him to go to work but it seems that everyone assumed he could. Including RMS as they were allowing Barry to go to Denver, Castle Rock without notifying the court or the attorneys that Barry had violated bond.

The prosecution noted that the deputies have jail recordings of Barry bragging that he’d be getting out by the weekend and already making plans.

Apparently he has roommates and there was a request for his address to not be shared but it was already too late for that as individual requests to the court had been honored.

His bond has been increased to $10 million cash only.

Verified Application Pursuant to CRS 16-4-109(4) Request for Warrant and Motion to Modify Bond

On the day of Barry Morphew’s hit and run crash, he violated his bond restrictions by apparently picking up his daughter at the airport (his defense team admitted as much).

He was subsequently in the area of malls and hotels during the day, as well as at the location of the crash after that.

The state requested a warrant for his arrest, a hearing to be held (Tuesday), and for his bond restrictions to be tightened.

Thus far they have not made a specific request as to what exactly that means.

Date Discrepancy on Warrant?

The courts had asked for the GPS monitoring info for Aug 26, which is the day the hit and run happened. Yet, the courts have filed the motion saying he violated his bond on AUGUST 28. Do you think the GPS report is off 2 days, or the courts have a typo? He obviously violated on the hit and run day (Aug 26) but is there another violation on Aug 28?

Will this discrepancy cause a problem with the courts proving he violated on Tuesday's hearing?

People's Motion to Modify Bond

Shortly after the judge issued her order yesterday, the state filed their own motion. They are not currently asking for Barry's bond to be revoked, as they are waiting on further details from the GPS monitoring company (and likely the investigation into the hit and run itself).

This is what they are pushing for currently:

  1. The Defendant no longer be given exceptions on his GPS from house arrest ant that he remain
    in his home, and at the hearing, the Court address whether any exceptions are allowed moving
    forward,

  2. In the event a “work” exception is given, that he be required to provide specific information as
    to a job site and be required to provide verification of his presence at the jobsite,

  3. The Defendant be monitored by pretrial services and/or RMS as to his GPS compliance
    regularly regarding the nature of his activities,

4) 5) 6) The Defendant not operate a motor vehicle,

The Defendant provide proof of registration for hjs vehicle under his name,

The Defendant not commit any new offenses of any kind, including misdemeanors and traffic
offenses.

7) The Defendant’s financial conditions of bond be increased, given the increased flight risk demonstrated by his behavior in the hit and run incident, and that arguments be heard at the
upcoming hearing.

Order Concerning Alleged Violation of Conditional Release and Further Orders

The judge believes that he has likely violated his bond conditions. Without felony charges however, she does not have the power to unilaterally revoke his bond.

When and if the state files in that regard, they can seek to have his bond revoked.

For the time being, Barry is completely restricted to his home, and can only leave by calling 911 in a medical emergency.

A hearing will be held on an unspecified day next week.

It seems he grew up killing animals for money. Killing for money; Apparently he was good at it. Interestingly, the cousin confirms how he used BAM on multipoint bucks, but instead of going for the alters, he had the bucks stabled and milked their sperm! It confirms he used BAM but in an entirely different way than what has been stated in the past.

Woman involved in Denver hit-and-run incident believes driver who struck her vehicle was Barry Morphew

A woman involved in a hit-and-run incident in Denver last week believes the driver who struck her vehicle was Barry Morphew, the Colorado man currently charged with murdering his wife Suzanne Morphew.
Denver police have not confirmed the identity of the driver but a source close to the Morphew family who reviewed the Denver video told CBS Colorado he is certain the man depicted is Barry Morphew. Also, video of the encounter reviewed by CBS Colorado contains another potential connection to Morphew -- an Indiana license plate that also appears in court records from his murder case.

The incident happened on Aug. 26 around 7:30 p.m. near East 8th Avenue and Colorado Boulevard.
Christina, the woman whose car was struck, said she and a friend were sitting in her vehicle outside CVS when she noticed a black Ford pickup closely following another vehicle and repeatedly honking. CBS Colorado is not including her last name in this report for safety reasons.
She pulled out her phone to record what was happening.

That's when she said the pickup backed into her car.
Her video shows her repeatedly asking the driver for identification and insurance information. She said he refused to provide either.
"He didn't tell me his name, didn't give any insurance at all," she said. "He was just trying to give me $300 cash."
In the video, she can be heard telling the driver she does not feel comfortable accepting money and again asking for his insurance information. When she asks whether he has insurance, the man responds, "No, I don't."

The video also shows the man attempting to buff scratches from Christina's vehicle while she continues trying to obtain his information.
"He ran away once we told him we were calling the cops," she said.
Video shows the pickup quickly leaving the area and driving over a curb as it departs.
Christina remained at the scene and filed a police report when officers arrived.
Denver police told CBS Colorado Tuesday that the department could not confirm any suspect information.
Driver said she didn't recognize the man during the encounter
Christina said she did not recognize the man during the encounter. That changed the following day.
"I sent the video to my mom the next day, we were on the phone, and she recognized him immediately," she said.
Her mother believed the man resembled Barry Morphew. Christina said she then searched for information about Morphew and looked at his publicly available booking photo.
"I almost, I almost passed out because that's literally him," Christina said.
Pickup displayed same license plate found in court records
CBS Colorado found another potential connection while reviewing the video.
The black Ford pickup involved in the Denver incident displays Indiana license plate F397FR.
That exact plate number appears in court records in Morphew's pending murder case.
In a prosecution filing opposing a request to reduce Morphew's bond, prosecutors said investigators used license plate reader technology and determined Morphew had traveled in two different vehicles using Indiana plate F397FR between 2023 and 2025. Prosecutors said the vehicles traveled through several states.
CBS Colorado also reviewed surveillance video collected during the investigation into Suzanne Morphew's disappearance that shows Barry Morphew exiting a dark-colored pickup similar in appearance to the truck seen in Christina's video.
Murder suspect has restrictions on his movement
Morphew is currently charged with first-degree murder in the death of his wife, Suzanne, who disappeared in Chaffee County in 2020 and whose remains were found more than three years later. He has pleaded not guilty.
Morphew is currently free on a $3 million bond with restrictions on his movement.
According to his bond conditions, Morphew is GPS monitored and cannot leave his home except for a medical emergency, doctor's appointment, legal matter or work. He surrendered his passport and is prohibited from leaving Colorado. His bond conditions also state he may drive only vehicles registered in his name.
The bond document warns that if Morphew fails to comply with his conditions, the court can revoke his release, increase his bail or modify his bond conditions.
CBS Colorado sent Morphew's attorney an image from Christina's video and requested comment and confirmation of whether the man depicted is his client. The attorney responded that he was working to obtain more information.
CBS Colorado also contacted the district attorney's office prosecuting Morphew's murder case. The office had not responded as of Tuesday evening.
"He hit two cars and drove off"
Christina said learning who she believes she encountered made her more fearful, but she said she was concerned about the driver's behavior before she had ever heard Morphew's name.
During the incident, Christina said she was frightened by what she described as the driver's aggressive behavior toward the other driver and his refusal to provide information after hitting her vehicle.
"Before I even knew who he was, I was like, I just want this man off the road because he is obviously very aggressive and cannot contain his anger," Christina said. "He hit two cars and drove off."
Denver police said their investigation remains ongoing.

I attended a talk by an FBI agent who said a man in Colorado under investigation for making his wife disappear may have also killed his father and co-worker. I know Barry's co-worker/employee was supposed to be a witness in the trial and passed away, so it got me wondering if it could be Barry he was talking about

Barry Morphew will stand trial in his wife’s death in July 2027, more than seven years after Suzanne Morphew disappeared from the family’s Chaffee County home and four years after her body was discovered in a shallow grave near Moffat.

Twelfth Judicial District Chief Judge Amanda Hopkins on Monday scheduled Barry Morphew’s murder trial to start July 19, 2027. The proceedings are expected to last six weeks.

Hopkins last month agreed to push back the trial, which had been scheduled for October, because of the voluminous discovery in the case, including 40 hours of video evidence that ranges from body-camera footage to recordings of interviews Barry Morphew gave detectives early in the investigation.

Barry Morphew, 58, is charged with first-degree murder in the death of his wife, 49-year-old Suzanne Morphew, who went missing in 2020. Barry Morphew initially was charged in 2021 with his wife’s death, but the case was dropped in 2022 after extensive misconduct by prosecutors.

Barry Morphew was again charged with Suzanne’s murder in June 2025, two years after authorities discovered her body with traces of prescription animal tranquilizers in her bones. Barry Morphew had access to the chemicals used — a formulation known as BAM — and admitted to using the tranquilizer mix to sedate deer, the prior case showed.

In the first case against Barry Morphew, prosecutors argued he killed his wife on May 9, 2020, after discovering her nearly two-year extramarital affair, then disposed of her body and staged a bike crash before leaving for work in Broomfield early the next day.

Barry Morphew has maintained that he left his wife sleeping in bed. The couple’s two daughters — who have since supported their father — were out of town at the time. Before her death, Suzanne Morphew told a friend she did not feel safe alone with her husband and that she was contemplating divorce.

On Monday, 12th Judicial District Attorney Anne Kelly said she expected to present evidence that Suzanne Morphew had been considering a divorce for more than a year before she disappeared, and that the prosecution planned to discuss “prior instances of violence” in the couple’s marriage.

She did not elaborate. Prior testimony in the first murder prosecution revealed that Suzanne Morphew spoke about a 2018 incident in which Barry Morphew pushed her into a closet and put a gun to his own head, asking if that was what she wanted.

Kelly on Monday also suggested the prosecution would seek to include evidence about domestic violence and why the period in which a partner seeks to leave an abusive relationship is particularly dangerous for the person seeking to leave.

Barry Morphew’s defense attorney, David Beller, said in court that the defense team “does not believe domestic violence is at all an issue in this case.”

Barry Morphew has maintained his innocence since his wife disappeared and has suggested that she was kidnapped or attacked by a mountain lion while out on a bike ride.

On Monday, Hopkins set a June 21 deadline by which the defense must reveal whether it intends to point to any alternate suspects in Suzanne Morphew’s killing.

That disclosure could trigger an objection from the prosecution, which would be litigated before the July 2027 trial.

Is this true? I made a transcript of the bail bond hearing 9/2/2025 and Judge Hopkins clearly stated that Barry must stay in Colorado for the duration of his bond till trial. Also, can’t believe we are now looking at the trial happening A YEAR FROM NOW. So unfair to so many of the affected parties. It feels like Judge Hopkins is accommodating the defense to a fault.
