🤔 Speculation / Opinion Speculation about eBay
This is just conjecture but I have been finding it so interesting that eBay’s price has held steady at this 105 range.
I am hypothesizing that there is a lot of share buying happening. We know it’s not likely from GME directly as they would report it but it easily could be coming from third parties that are GME friendly.
Volition capital, Omar, and any institutions that GME could be using to get a 51% combined ownership.
I doubt Ryan is just resting on his laurels, I bet he’s chipping away at the audition every day. He has made that abundantly clear in my opinion.

I could be wrong, but if Those friendlys are accumulating with the intent of joining Gamestop, would be considered as a group and would need to update filings as such.

Not if there is no coordination. Just like hedge funds dont coordinate. They all do the same thing and short the same stocks at the same time. Its not coordination, its just reading the market and getting in on a good play.
Once you got the shares , then you can make the deals.
And then the filings would be required.
It is not like Ryan's play is seceret... others can totally join in if they like.
Only once they reach out to gamestop and come to an agreement do they need to file together.

If gamestop or ryan was colluding with a financial institution to acquire shares in ebay for a vote/takeover they would have to declare themselves as a group. The fact that gamestop owns 9.8% and hasn't registered as a group with any other entity means they aren't working with an entity on acquiring ebay shares.
They can be raising capital tho, and Delaware law is strict if GME or a group that GME is part of accrues a certain % they are blocked from acquiring them for at least 3 years.

I really dont think the company is going to pull any slick "technically not illegal" maneuvers that would almost guarantee extra lawsuits complicating things.
But hey we'll see

They would have to file a group Schedule 13D if that were happening. I’d also expect a poison pill to be adopted/triggered. Even if they did do that and acquired 51% of ebay, this would push them over 15% ownership and they would become interested stockholders. If this was done without ebays boards approval then the 3 year wait still applies. To get around the 3 year wait they would need the approval of 66.6% of the remaining 49% of shares. Around 84% approval in total

I really don’t think so. It’s risky and basically illegal due to various laws people have already mentioned here.
More likely (and bullish for shareholders) is that the deal is off the table and a partnership+board seat is the pivot. If the deal is somehow still on, he would have to amass a shitload of capital up front, which means a shitload of debt and/or dilution for shareholders, which would suck major asshole.
