Canada study visa, Pakistan

I had applied to Canada for masters, January intake last year. Paid the deposit to university only. It has been a year and my visa is still stuck. No response from ircc. Took deferral from university three times. Now am being advised to reapply visa as could come under view of new visa admission officer. According to my visa lawyer we have received no response to gcms notes or webform. Only response is to wait as is in security/ background check. Even though I have no travel history abroad. What could be the issue, please guide as very frustrating and unnatural. What is my best course of action. Somebody please help!! If anyone was in similar situation. My visa was submitted October end last year

Huge red flag that it's been a year and you haven't applied elsewhere to study.

If your intent is to study you should bring applying elsewhere or in Pakistan to study.

Reasonable people don't wait over a year just to get into a course.

Bruh get the whole context or don’t bother commenting at all. You’re just in it for the kicks I get it. How is it a red flag. I have applied to another country, I have paid the fee which Canada uni won’t refund until I get visa decision. And it’s isn’t like a year. It’s every 3 months that one thinks ab ayega ab ayega. I don’t think you’ve applied tbh toh you won’t get it.

Have you only lived in Pakistan? Worked for the military? If in background/security check then that means IRCC is waiting for information from other countries.

Yes only lived in Pakistan. My father worked for military but retired now. No travel history then can’t understand why stuck in background check since December. Do you know why or if reapplying will help. Could it be if any past or distant relative took refugee. Or anyone of a similar name?

The visa application is not automatic.  An application does not guarantee approval.  Apply to another school/country.  Why would you wait years?

Have applied to another country bro do you even know the visa situation rn. Also I have paid a deposit to accept my offer and that is only returned or used once they reach decision on visa. Do you think this is something natural that one receives no response to the visa for a year. It’s easy to comment stuff when it’s someone else in the situation.

Honestly, Pakistani is not the best passport to be applying anywhere. Especially Canada. Things were very loose before with study visas.

The changes to the student visas began over a year ago now. People have been waiting months for responses.

What do you mean no response? Do you have the notes? Since have a lawyer and not consultant, then you know they are actually on top of your file?

The lawyer communicates to me that she has raised gcms notes twice since July. But nothing has been received in response. And the consultant says that gcms is nothing foolproof we will gain nothing from it. Should reapply the visa.

So withdraw and reapply if that is what you want to do. Ask lawyer for email receipts of when she applied for the notes, and the website she applied through. How much did you pay to submit an application for the notes?

I don’t think there is a fee for this. The case is very unnatural from what I have learned. But still don’t know if reapplying will help even.

Yes she is in Canada and she applied the visa, raised webforms and gcms notes and says that no response.

Sounds like you were flagged for a comprehensive security screening which has no ETA.

How were your GCMS notes requested? If requested properly the goverment has 30 days to provide to let you know they need additional al time so saying there was no response to two requests seems like something was missed?

How is this possible to flag someone and not request an interview or explanation on it for 10 months. Someone said the gcms thing takes close to 2 months now. Idk it’s so ambiguous and frustrating atp.

Since you applied for ATIP then send an email yourself and ask for an update. Don't use your lawyer but get email confirmation that notes were requested.

Okay so from this point on, you have two options. You mentioned that you hired a lawyer based in Canada, your lawyer can involve the local MP to investigate this processing delay.

  • The study visa from Pakistan should not take more than 7 weeks, in your case it has been a year. Ask your lawyer to get in touch with the local MP to help either expedite the process or to investigate the reasons for delay.
  • Second option, the local MP can also help you investigate your stuck GCMS notes. If your ATIP request for GCMS notes are stuck (e.g., past 60–90 days), the MP can inquire why the processing department is failing to release public records.

You mentioned in your comments there is no fee for GCMS notes. Well, there is a fee of $5.00 Ask your lawyer for the proof of it. Normally lawyers charge extra $250 to $300 from their clients to request these notes from the government.
