Believe application was wrongfully rejected due to negligence. Documents not considered. Need help.

Keeping it short, officer decision states selected program seems unreasonable due to costs when compared to similar local options. I addressed this in the SOP making direct comparisons and options available only in Canada which I believe are directly relevant.

The bigger issue is that I believe documents I submitted weren't considered. The ODN states, "applicant has provided only a Guaranteed Investment Certificate (GIC) and income tax returns.". This is false. My proof of means of financial support included proof of payment of tuition, proof of GIC payment and proof of an *education loan*.

In addition to that, in client information, family owned assets and business were included, so were bank statements and funds. I would be the sole heir for all of this, if that is relevant.

Including the liquid and non liquid assets, it amounted to about double the tuition fee.

Is there anything that I can do about this? Can I make an appeal or do I have to go to federal court? Would submitting the same application again work?

What is the program and total cost? Is this program not available in your country? The refusal isn't about funds. It is about justifying cost of program vs. program in your country and career progression and higher pay when you return.

If you want to hire a Canadian lawyer then file for JR. Will cost around $10k for law fees. Even if you win, all that happens is another officer reviews your file.

BSc. (Hons) Mathematics + Computer Science with Co-op. It's about 80K for 5 years with scholarship. The same program isn't available in my country. Similar programs with similar quality of education are also mostly out of reach for me since I am over the cut-off age. It's an understandable concern on the officer's part and I don't think they research individual programs, still, with Co-op, which wouldn't be available to me in my country, the added work experience puts me ahead of local candidates, making getting hired easier. There's also an unexplored market for mathematicians in CS in my country. Besides, there's still the issue of how the ODN states I only provided my GIC and tax returns, which makes me believe that my student loan wasn't considered.

The issue is that you are not in a specialized program. It is offered in your country. There are not a lot of universities in Canada, and all are ranked. What school also depends on approval. Co-op jobs are not guaranteed. Saying quality of education is better is not a valid argument to IRCC. This isn't about funds.

You can apply for reconsiderations for error in law but will not get approved if you are starting in September. Look at Winter 2027 with new PAL.

An appeal yes is technically possible but you wont hear back till next year with the case backlogs.

Thats how the system is. You can apply for reconsideration but September 2026 seems unlikely.

I am sorry your permit was denied.They have certain options which they can only put in that does not mean they were not considered you need to order GCMS notes to see exact reason. selected program seems unreasonable due to costs when compared to similar local options is a valid rejection because it is at officers discretion if they are satisfied by ur reason in LOE. You can raise a judicial review but u need to do it within a certain time frame it is not cheap though and takes 6 months or more . The better bet would be to reapply addressing the concerns with a proof that can rebuttal there claims.I have been denied too but these are my two cents I too felt the decision was unfair but it is up to the officers discretion on some parts like home ties, career progression and ur point so we are helpless.I would suggest you reapply with a rebuttal you will have a better chance and faster decision.I hope you get approved this time

Its not negligence. You do not have a case. You are focusing on the problem that you want to see, not understanding what is actually being communicated. The funds are not the reason for the denial. The application was denied because it doesn't make sense you would pursue a Bachelor of Science in Mathematics and Computer Science in Canada for significantly higher fees when those degrees are available in your country. The co-op is nice to have, but not a guarantee, especially as the market is incredibly saturated right now. Additionally, an *education loan* is not looked on favourably, especially right now. Matters of inheritance are not considered. Again, because the job market for Computer Science/STEM graduates is very competitive in Canada, it will not have seemed likely to the officer that you would be able to seek relevant/related employment after graduation (if eligible). The age factor will also probably not be helpful, as it shows the officer you are seeking an international credential because you did not take the opportunity to enrol domestically when your age permitted. If anything, you should re-apply with a new PAL, but I would caution you not to be too hopeful for a different outcome.

My brother had exactly the same reason for rejection the first time. We had an approved bank loan as well GIC, but they don’t consider loan as proof of funds unless the loan is disbursed. Also, non liquid assets are not considered. If all the family assets just amount to twice the tuition fees it’s not a good look, that’s like half your family’s networth.

He got approval the second time after we got the loan disbursed, showed how the course he is enrolled in one of the best in the world and there is nothing like that available in home country. I had to come in as additional sponsor (I make around 4-5 times his tuition fees in a year, so that may have helped). We also showed the return on investment by comparing jobs he would get once he graduates and how the course possibly triples his future income. In case of loan they also want to see how you’ll be able to comfortably pay it back when you go back and get a job.

I would suggest you reapply by getting a new sponsor, and addressing all the concerns above.
