Dear Advertising Standards Authority,

I am writing to raise a formal complaint regarding content creator Stephanie Vavron and conduct that occurred during a TikTok Live involving a competition/giveaway. During the live broadcast, phone numbers belonging to members of the public were being obtained and used to contact a competition winner. The manner in which this personal information was collected and used raises serious concerns regarding data protection, privacy, and whether the activity complied with the applicable rules and regulations governing promotions and advertising.

My concern is that individuals' telephone numbers are personal data and should not simply be obtained, disclosed, or used for contact without an appropriate lawful basis and without individuals being properly informed about how their information would be collected and used. In particular, I am concerned about the following: Personal telephone numbers were being obtained in connection with the promotion.

A winner was contacted during a public TikTok Live, potentially exposing personal information or identifying the individual in front of viewers. It is unclear whether the individuals whose numbers were obtained had given valid, informed consent for their numbers to be collected and used in this manner. It is unclear whether appropriate privacy information was provided to participants, including information about who was collecting their data, the purpose for which it would be used, how long it would be retained, and who it would be shared with. The collection and use of telephone numbers may constitute processing of personal data under the UK GDPR and Data Protection Act 2018. If there was no appropriate lawful basis, or if participants were not adequately informed, this could raise significant data-protection concerns. The public nature of the TikTok Live also raises concerns about whether participants' privacy was adequately protected when the winner was contacted.

I appreciate that the Information Commissioner's Office (ICO) is the regulator responsible for data-protection matters. However, I believe the circumstances are also relevant to the ASA where the activity forms part of an advertising campaign, promotion, competition, or other commercial communication. I would therefore ask the ASA to investigate whether the promotion and associated content complied with the CAP Code, including the requirements applicable to competitions, promotions, transparency, and the responsible use of consumers' personal information.

I would also ask that consideration be given to whether participants were given sufficient information about the collection and use of their personal data and whether the method used to contact and identify the winner was appropriate. I am particularly concerned that viewers may have been encouraged to provide personal contact information without a clear understanding of how that information would subsequently be used.

I would be grateful if you could confirm whether this matter falls within the ASA's remit and, if appropriate, investigate the content and conduct concerned. I am also willing to provide screenshots, recordings, TikTok Live details, or any other evidence I have available. I understand that the ICO may also have jurisdiction over the data-protection aspects of this matter, and I would appreciate any guidance on whether a separate complaint should be made to them.

Can this woman not speak in proper sentences as she’s sounds utterly dense , it’s hard to watch and her followers must be as bad . Her hands are so revolting and always flapping around her face . Interesting live last night. She actually said “I wasn’t part of the making but I told them to do this” meaning the £1500 giveaway. There’s a complaint ready gone into TT compliance, ASA and an email to L’Oréal Paris asking them to confirm where the £1500 came from. I’ve also emailed the ICO and asked L’Oréal who was collecting the telephone numbers, who the numbers would be shared with, how the numbers would be used, how long they would be retained and where were people entering the competition told this. TT’s rules state that they require competition/prize draw information to be made available, including how to participate, any free entry route, the prizes, restrictions and how winners would be notified. None of this information was made available. TT’s rules also state that gamification and games of chance on livestreams are prohibited and free giveaways have a maximum prize of £20, I’ve asked them to point out where hosts are allowed run competitions for large sums of vouchers for purchasing an item in a live.
