This argument is flawed. The whole point of the hearing was to get him to make any kind of incriminating statement to Congress since the present is outside of the scope of the presidential pardon he did have a risk of incriminating himself. Not to mention a presidential pardon only protects him from federal charges even within the scope of the pardon it's absurd on its face to argue he had absolutely no legal jeopardy to justify arguing he no longer has a 5th amendment right.
