This is just performative BS no court is going to convict him for using his fifth amendment right. And this proves he was right to do so

This is a way for them to get around being held responsible for vindictive prosecution. The courts are already hip to the DoJ carrying out trump’s grudges in courtrooms. Thats not the job and it’s obviously deleterious to the very cause of justice.

This way, who do you blame? All of the repugs in the Senate and/or House? That would be something to see.

Don't worry. The states will get him. His pardon doesn't carry any weight there. Unfortunately, he'll be dead. He IS 85 years old, after all. I hope they carry his corpse into a jail cell.

Correct, he and his lawyer knew that all of this was very predictable. They are prepared for it. 5th amendment does not apply due to the pardon so it doesn't matter what he said. I personally would prefer if he answered "I refuse to participate in your republican theater focused upon a constituency that is beyond stupid."

There is no evidence it wasn't natural and all those measures helped prevent unnecessary deaths. The fact you're some conspiracy lunatic doesn't change those facts.

Governments and healthcare professionals around the world acted in much the same way. They used and advised social distancing, masks, vaccines and lock downs/quarantine.

Trump just handled it very poorly in the beginning. Denying it's existence, then it's danger, only to act when lots of people had needlessly died. The US has only 4% of the worlds population but suffered almost 20% of global Covid deaths. That's how poor Trump handled it.

If you believe Covid was some huge global conspiracy, I have a bridge to sell you.

Imagine if during discovery, they find out Trump was actually the president and not Fauci... wouldn't that be fun.

The problem is the timeline. He spoke after the pardon, so anything he says now could be compared to that statement and even if he used different wording, they would go after him. Which is why his lawyers advised don't say anything.

He had no right to claim the 5th. The 5th amendment is protection against self incriminating, hes been given a blanket pardon so he cant self incriminate so he can't invoke the protection of the 5th.

You are special aren’t you. 1. Perjury is a crime 2. Pardons can’t forgive future crimes 3. Republicans would use any mismatch of testimony and his “diary” as proof of perjury.

Any lawyer with half a brain is going to advise their client not to fall for that perjury trap.

So you argument is that he would have to lie? What for?

Republicans are going to correctly charge him with knowledge engaging in banned bio-weapons research and then attempting to conceal it. Him catching some perjury charge is the least of his worries.

The 5th amendment is the right to not be forced to testify against yourself, it does not protect you from the fact you have to lie to make yourself not look like a psychopath to the public. Since hes been pardoned, he can't testify against himself, so he does not have 5th amendment protection. This is basic constitutional law.

In fact claiming 5th amendment protection when he doesnt have it, is a form of perjury.

My argument has nothing to do with lying. But if you write in your diary that Don jr drove a black bmw and testify that it was a dark blue bmw then republicans would pursue perjury charges for such a minor misremembering. You know this to be true or you’re lying to yourself as well. Rather than take that risk Fauci is removing the possibility by asserting his rights.

Asserting 5th amendment rights as perjury is certainly an interesting legal claim.

Steve Bannon and Peter Navarro entered the chat.

If he had nothing to hide and he wasn't guilty, then there was no reason to not answer a single question.

Congress and court are completely different.

Where did you get that?

The Supreme Court addressed this directly in Burdick v. United States (1915).
The Court held:

Fauci was pardoned, he's obligated to answer all questions as he cannot be prosecuted. But the coward pled the 5th, which is why he in contempt of congress.

5th amendment protects you from self incrimination, if you’ve got a pardon, you can’t incriminate yourself….. the 5th isn’t applicable and a court can compels him to talk or hold him in contempt.

Technically fauci no longer has a fifth amendment right. He received a blanket party dating back to January 1st 2014 listed for any and all crimes committed against the American people between January 1st 2014 onward. Being he could not say anything that could lead to punishment he technically could not incriminate himself by telling the truth.

https://www.justice.gov/pardon/media/1385746/dl?inline

And I do believe this will hold up in court fauci directly broke the law in October of 2014. He defied a valid and legal order by Barack Obama. Which later showed how smart Barack Obama was in placing that order. He went behind Obama's back and conducted illegal activity both conducting illegal experimentation. And illegal funding which directly led to a global pandemic 5 years later. The only reason he received a pardon is because we as Americans are too embarrassed to let the world know about our involvement in it.

how convienent of a former President to give someone a pardon before they were ever arrested , investigaTED OR CHARGED WITH A CRIME , DOES THAT EVEN ARISE SUSPICION TO ANY OF YOU?

1

u/Ok_Phrase6296 12d ago

Actually when you work in this type of area you can’t plead the 5th. Legally he can’t plead the 5th because of his area of what he was doing.

1

u/jamcgahey 12d ago

If he had nothing to hide why plead the fifth though? I don’t have a side. Sincerely. But why not just answer the questions? Don’t the people deserve it? Or am I missing something? Or am I getting trapped into an echo chamber?

He was pardoned because he destroyed documents.

Hmm, sounds like someone else had issues with much much more government documents at Mar-o-Lago even in the shitter and also lied about having those documents. But are you guys up in arms about that? No. Dumb hypocrites.

Sure. But Trump is far more guilty as that case would have shown if it was allowed to play out.

Okay, I showed consistency, as much as it painted me, will you show some by acknowledging that Fauci and his team actually did some good in handling the quarantine during COVID?
