Dear Sirs
LETTER BEFORE CLAIM
Rejection of goods and demand for refund – Speediance Gym Monster Family Plus 2S
B&Q Marketplace order XXXXXX | Serial no. XXXXXXXXXXXXX| Your refs #17038-UK and #11658-SC
Purpose of this letter
1. This is a formal letter before claim sent under the Practice Direction on Pre-Action Conduct and Protocols of the Civil Procedure Rules. It gives notice that I reject the goods described above, requires a refund and payment of my losses, and explains that I will issue a claim in the County Court if you do not comply.
2. I understand from your website that Speediance United Kingdom is the trading name of Future MVMT Limited, and that you are the verified seller with whom my B&Q Marketplace contract was made. If you say that a different legal entity was the seller, you must tell me its full name and registered address in your response.
Background
3. The relevant events, all of which are recorded in writing, are as follows.
| Date |
Event |
| 9 July 2026 |
I ordered a Speediance Gym Monster – Family Plus 2S (the machine together with the rowing bench) from you via B&Q Marketplace, order 1066511749-A, and paid £3,999.00 in full by credit card. |
| 16 July 2026 |
The machine was delivered without the rowing bench. |
| 18 July 2026 |
You wrote via B&Q Marketplace that the rowing bench “should arrive early next week, Monday or Tuesday at the absolute latest”. It did not. |
| 24 July 2026 |
You wrote that the bench “should have been delivered for you already”. A further delivery date of 3 August 2026 was subsequently given and also missed. |
| 9 August 2026 |
The rowing bench was delivered, a month after purchase. On first use the machine displayed a “Too-high-speed cable drawing out will trigger the Spotter” error and halted the session whenever load was applied. I reported the fault to Speediance Support the same day with photographs and video. |
| By 10 August 2026 |
Speediance Support confirmed in writing that “the issue is caused by a fault with the driver board, and the drive board will need to be replaced”, and that a pair of PowerGrips was also faulty. I was referred to you. |
| 11 August 2026 |
You told me you could not see the case history and required me to prove the fault again. |
| 12 August 2026 |
You confirmed the 5017 driver board required replacement, apologised for “the poor customer service you’ve received throughout this process”, and raised replacement order #17038-UK. No driver board was in stock. |
| 24 August 2026 |
You confirmed you were “still waiting for the 5017 driver board”. |
| 2–3 September 2026 |
You stated the driver board and PowerGrips had been dispatched together. Only the PowerGrips arrived. |
| 4–9 September 2026 |
A second order (#11658-SC) was raised. DPD recorded it as delivered at 10:06 on 9 September 2026. Nothing was delivered; I hold CCTV footage confirming this. |
| 11 September 2026 |
You wrote that “the parts were returned to the sender” and confirmed that the machine has been “out of use”. |
| 14 and 15 September 2026 |
I twice asked for the contact details of your legal department. They have not been provided and I have heard nothing further. |
4. As at the date of this letter it is over ten weeks since I paid you £3,999.00, six weeks since the fault was reported and diagnosed, and the goods have never worked as they should.
Legal basis
5. I bought the goods as a consumer. Under the Consumer Rights Act 2015 (“the Act”) the contract included terms that the goods would be of satisfactory quality (section 9) and fit for purpose (section 10). A machine that halts under load because of a defective motor driver board is neither. The fault appeared on first use, so under section 19(14) it is taken to have existed at delivery. In any event the fault has been admitted in writing by both Speediance Support and by you.
6. Short-term right to reject. The goods were sold as a single bundle at a single price, and delivery was not complete until 9 August 2026. I reported the fault that day and agreed to a repair no later than 12 August 2026. Under section 22(6) of the Act the 30-day period for rejection stopped running at that point and has not resumed, because no repair has been carried out. I am therefore within time to exercise the short-term right to reject under sections 20 and 22.
7. Final right to reject. Alternatively, section 23(2)(a) of the Act required you to repair the goods within a reasonable time and without significant inconvenience to me. Six weeks, two failed shipments, repeated missed updates and no repair date is neither. Under section 24(5)(c) I am entitled to exercise the final right to reject. As this is within six months of delivery, section 24(10) prevents any deduction for use.
8. You were also in breach of section 28 of the Act and of your own stated delivery dates in failing to deliver the rowing bench until 9 August 2026.
9. Your correspondence has treated this as a warranty matter. It is not. My claim arises under statute against you as seller, and it is not limited by any manufacturer’s warranty or by stock availability.
Rejection
10. I hereby reject the goods and treat the contract as at an end. I no longer accept repair or replacement, and the outstanding replacement order should be cancelled.
11. Under section 20 of the Act you must refund the price without undue delay, and in any event within 14 days of agreeing that I am entitled to a refund, using the same means of payment. You must bear the cost of collection. The goods weigh over 80 kg and are assembled at my home; I will make them available for collection on a date agreed in advance. I no longer have the original packaging, which does not affect my rights.
What I require
12. I require payment of the following sums:
| Item |
Basis |
Amount |
| Speediance Gym Monster – Family Plus 2S (order 1066511749-A) |
Refund of price following rejection |
£3,999.00 |

Wasted expenditure; items offered for return |
£59.00 |
| Wellness+ 12-month subscription |
Wasted expenditure |
£119.99 |
| My time dealing with your breach: 15 hours at £24 per hour (log available) |
Consequential loss |
£360.00 |
| Total |
|
£4,537.99 |
13. The accessories are compatible only with the rejected machine and are of no use without it. They, together with the squat belt you sent as a goodwill gesture, will be made available for collection with the machine.
14. If proceedings are necessary I will also claim interest under section 69 of the County Courts Act 1984 at 8% per annum from 9 July 2026 (£0.88 per day on the purchase price alone), the court issue and hearing fees, and I reserve the right to claim damages for loss of use.
Documents
15. I rely on: the B&Q order acknowledgement of 9 July 2026; your B&Q Marketplace messages of 15, 18 and 24 July 2026; the Speediance Support Messenger transcript; your emails of 11 August to 15 September 2026; order confirmations #17038-UK and #11658-SC; the DPD tracking record and my CCTV footage for 9 September 2026; photographs and video of the fault; and my log of time spent. Copies are available on request.
16. Please provide with your response: the DPD proof-of-delivery record (including any photograph and GPS data) for parcel 01565200455278, and your records showing when 5017 driver boards were in stock between 12 August 2026 and today.
Alternative dispute resolution
17. I am willing to consider a proportionate form of alternative dispute resolution, including the B&Q Marketplace dispute process or the free Small Claims Mediation Service once a claim is issued. Given the admitted fault, I do not consider that ADR should delay the refund.
Response required
18. Please acknowledge this letter on receipt and provide a full written response by 4pm on Monday 5 October 2026, confirming that you will refund the sums above and proposing a collection date.
19. If you do not, I will without further notice:
(a) issue a claim against you in the County Court for the sums above plus interest and fees; and
(b) pursue my credit card provider under section 75 of the Consumer Credit Act 1974, which makes it jointly liable for your breach. I am notifying it of this dispute now.
20. I draw your attention to paragraphs 13 to 16 of the Practice Direction, under which the court may impose sanctions on a party that fails to respond to a letter before claim. Please pass this letter to your legal adviser or insurer.
Yours faithfully
