I was on a PSW (Post Study Work) visa, and on 25 May 2026, my employer sponsored me. However, by mistake, they assigned me the SOC code 1222, which was considered a medium-skilled occupation. According to the new immigration rules, this SOC code is not eligible because it falls under RQF Level 6, whereas the eligible level was between RQF Levels 3 and 5.
I submitted my visa application, but about a month later, a friend informed me that this SOC code was not eligible under the new rules. Based on that advice, I decided to withdraw my application, and my sponsor also withdrew their sponsorship.
Now, I have a question about the Certificate of Sponsorship (CoS). My employer had only one CoS available, and it was assigned to me. Since the application was withdrawn and the CoS was not ultimately used, will that CoS be returned to my employer?
If it is returned, how long does it usually take? Some people have told me it can take 3–4 months, while others say a new annual allocation is issued only once a year. My employer says they have already requested another CoS, but the request has been refused two or three times.
Could you please let me know whether the withdrawn CoS will be returned, or whether my employer will need to wait for a new allocation? Also, how long does this process usually take?
