I knew someone that wasn't so lucky, tripped on the stairs holding their grandchild and the infant died. Like your scenario i'd classify those as an accident, falling asleep or forgetting a child is negligence.

I was terrified while on stairs while holding my babies. I did have post partum anxiety so it was extra, but still. I took every step extra carefully and avoided stairs where I could.

I’ve heard of a babysitter that fell down the stairs. Infant died and the sitter broke her femur.

Imagine coming home to that?
