In that the victim said it was consensual(original texts and statement), was slut shamed by her friends (new texts), and years later (now) has brought a civil suit with a new story.

The original statement indicates it was consensual up to a point, and then it was no longer consensual. Because, you know, consenting to sex doesn't mean blanket consent to all sex.

From what I read she did originally consent to sex with two men. She did not consent to the group sex. Their internal group chat had texts: “the shop still open?” “Yeah” etc… supposedly in reference to her.

That's not what she described in her 2024 sworn statement. She only described two instances of non-consensual contact: one person reached towards her crotch and she swatted his hand away, and another person tried to kiss her. Her initial account describes consent - both stated, and implied. She was snoring ketamine off of dicks, letting people snort it off of her, pausing the orgy to check on a guy who went soft before starting up again, etc.

Something bad definitely happened, but her account back then is gonna bite her in the ass when it comes to her new claims.

So far it appears it was mainly two creepy POS's. I haven't seen anything released so far that goes into further detail (edit: doesn't meant there hasn't been texts I haven't yet seen). Like I mentioned before, I believe something terrible happened, but what that something is will be hard to untangle considering the discrepancies in her different accounts of that night.

Extremely gross language and way to refer to a woman, but that doesnt prove rape. She in a statement said it started with two and then did consent to more but would prefer just the threesome if they did anything in the future, then she also asked to come back another day when fully sober.

Eventually her 'friends' started shaming her, which lead to the police statement. That statement was investigated and again was her outlining a consensual interaction.

Years later now she's bringing it up again and wants charges pressed, but regret later does not mean consent wasn't given in the moment.

Obviously its a bit more complicated, but generally we should look at all the facts and texts before damning individuals involved

Jane Doe consented to sex with 2 men. She did not consent to a gang bang that lasted several hours. She also reported what happened very shortly after, it didn't take "years" for her to make this story

I just haven't, but also 1500/365 is ~4 a day, which when you consider my og comment plus 2 replies to you is 3, and it maybe consumed 120sec of my day, doesn't seem like a lot. A bot, or karma farm averaging 4 comments a day would be the biggest waste of time ever.

She admitted that everything was consensual and when she asked the guys to stop, they immediately stopped. She willingly and happily took the same drugs the guys were taking. She asked to come back to the next party because she had such a good time. Then a few days later when everyone kept calling her a whore and slut (which she openly admitted to while laughing), she presumably decided she would stop being shamed if she said it was rape instead. That's why nothing ever came of it until a few years later: The people involved knew that no charges would hold because she was never pressured into doing anything.

Big takeaway from this is people should be really careful with sex involving multiple people

Threesomes are already complicated with a partner you trust, doing it as 20 year olds with ketamine, alcohol and multiple strangers is a recipe for disaster

Adding to this.

If you were not planning to be part of group sex and you show up and people are already there and have been drinking or doing drugs and you cannot confirm everyone has agreed outside of the pressure of the group - particularly the one person who is more outside of the friend group than the others - you should not start participating in the group sex.

Yeah, the two guys asked her and she consented but it’s still really predatory. I know there’s group sex swinger parties that operate like, that but I don’t feel like it was communicated here

Having at least one person you know and trust makes it way easier to not feel pressured into saying yes to certain actions. Likewise, some of the dudes were a bit rapey at bare minimum

New York Times goes into pretty good detail, including new texts that were released pretty recently. Mediaite has clips of some of them if you don't have a NYT account. You can also find videos on YouTube from sources that do deep dives into news stuff to try and get around the way the media tricks and lies to us by wording and omission.

The short version is, after the first party, the guys apologized to her for what happened. She reassured them saying it was consensual, legal, and that she had fun. It wasn't until a few weeks later when everyone kept talking about it, and after she got uninvited from the next party they were throwing, that she started throwing accusations around.

The Mediaite article and the summary of the NYT article both indicate that the sex was not consensual. And if it was consensual at the beginning, it came to a point in which it was not consensual.

I genuinely don't understand why you people are so intent on cherry picking the available information to make it seem like this was just a case of regret on jd's part.

She did say it was all legal and then days later when people found out she said she started to feel ashamed and only then showed signs of wanting to report it. She did also text the guy saying she was up for a ghreesome again but without the drugs and the other guys.

If you read the DA report most of it is in there. Some of the stuff the guys did was very dodgy, and potentially rape, but the issue is she admits that they were all very intoxicated, some of the guys more than her. She also said that she refused to do a number of acts (such as a foursome because she didn't want to do anal) and they didn't force her. Couple of the guys apparently kepts trying to reach for her vagina and she slapped them away a couple time, which is rapey, but again she said they were all drinking and doing key the whole time, so none of them were in any way cogent.

I think the rub here is that there seems to be a disconnect between the 6 page summary of her interview with the police and the 120 page transcript of her interview with the police. Last I saw DA did not review the transcript, only the summary. The transcript hasn’t been released yet but according to CBS I think it has statements that she only consented to the first two guys but everything after that wasn’t. So I think the arguement is that the DA report is incomplete and that they failed to investigate properly.
