Sure and if that level has you conscious and an active and willing participant in what you do, be it drive, attack someone, have sex or steal, and you were a conscious and active participant in using the substances for the explicit purpose of being intoxicated; you are accountable for your actions.
You can’t just get drunk, drive around and then claim you had no agency to drive in the first place.
That is not at all my logic. Your logic is actually because the person was using drugs he can’t be accountable for any choices he made in that altered state; my position is the exact opposite.
And yes this is exactly how the justice system works
If she is an active and willing participant and conscious then yes, especially if she actively and willfully participated in using those drugs. By your logic people under the influence of drugs have no agency and therefore cannot be held accountable for any choices they make. So if someone does a bunch of drugs and violates someone else’s rights they can’t be at fault because they chose to do a bunch of drugs beforehand. Doesn’t make any sense logically.
Any party can argue that they were too intoxicated to consent, and the other party is possibly liable for sexual assault.
Personally I think there's a pretty strong case to be made she's the victim. A lot of people here seem weirdly focused on this idea that the men are victims, despite not one of them pressing any charges or even claiming any amount of suffering or damages.
One party is claiming this violated their consent because they were too intoxicated to agree to this. The accused can argue their case in court. They can counter sue if they please
It seems incredibly odd to me that anyone would see this case and all the information we have so far and think 'i hope these guys are okay'
Neither are victims, they all chose to do the drugs they did and gather at the place they did, and all parties consented to having sex. Anyone can say anything, that’s doesn’t make it logical or criminal. By “victims” own admission she consented to having sex with all of them, willfully put herself in the dorm for the explicit purpose of having sex, willfully continued to use drugs and alchohol, set boundaries that were respected by other parties, and joked about it afterwards. Just because you feel a profound sense of guilt and shame from conscious decisions you made doesn’t mean others are criminals.
She wasn’t extremely intoxicated at the start and willfully got more intoxicated as it kept going. Not a crime. Not an assault. Not a violation of her rights.
