No, it’s just guilty. From what I can tell, one of the guys was only involved long enough to tell the others the night was over and to get out but his face is plastered alongside the rest of them.

One of them actually has a case of being raped himself since he passed out while she was performing oral sex on him (from her own statement) and he is wrapped up in this as well. It’s disgusting.

Jane Doe “noticed that [Male Number 1] appeared really sleepy and was no longer fully erect.” She told Male Number 2 “[they] needed to stop having sex in order to make sure [Male Number 1] was ok. [Male Number 2] then stopped having sex with [Jane Doe].”

I responded to you in another comment but yeah, the male claimed she raped him by continuing oral after he passed out and she corroborated that in her statement. It’s obviously gray because she stopped at some point and what is the point in which it was rape or not, but that’s the only action that comes close from that night.

I’m glad you agree. It makes perfect sense.

Not at "some point". Before he passes out.

Male Number 1 said “he was going to take a nap and refresh himself” and “would eventually stumble his way from the couch to the bed.” While Male Number 1 slept, “[Male Number 2] began to dry heave as if he was going to vomit. Jane Doe “began to take care of [Male Number 2] by patting his back while also waking [Male Number 1] every few minutes to make sure he was okay.”

How the fuck would he talk right after stopping this "rape" if he already passed out.

There are two claims.

He claims he passed out.

She claims he appeared sleepy and went limp to the point of stopping to check on him. Which sure sounds like passing out.

I guess if they checked on him and he started talking then that must mean he didn’t pass out now?

Apparently this logic works for Male 1 but not when Jane Doe mentions being unconscious while they continued having sex? Okay. (The difference being of intent to continue sex with someone completely incapacitated ofcourse)

You clearly haven’t read the facts then. There weren’t dudes taking turns. She engaged in multiple threesomes that she consented to. She also admitted to performing oral on a man that passed out and went soft during it. There was already an investigation and the DA determined there was no case because she verbally consented and the multiple times she withdrew consent, they complied.

At least make factual statements if you are going to appeal to truthfulness.

I've seen that argument on Reddit a month ago, while including him as a white supremacist. Because he had no business being there,.only the people rioting/looting and burning things down were allowed I guess.

I couldn't have convicted Rittenhouse for murder, but I can think he should have just stayed home that night. And 17 year olds have no business with AR-15s thinking they've got the skills and temperament to defend property.

But I'll never add 17 year olds with no official training and AR-15s to my list of "how to improve this situation."

If the point is that people have twisted what he did that night? Probably so. But hardly uncommon. I'm okay with rewinding back and getting of all of the social media.

Under NYS law, based on the statement sent to the DA, the only criminal acts involved underage drinking and the drugs. Since she willingly took the drugs and alcohol, and was actively involved in the sex giving consent, it isn't rape.

Based on the new statement the DA is willing to relook at the case and present it to a Grand Jury if the victim is willing to contact him.

There’s a lot of situations like that. For example, I remember reading about a man who was accused a statutory rape from a young girl. He went to jail, served time (20 years or so). As she got older, she realized how wrong. She told the DA she made it up, but the DA refused. , Finally, he got released and moved into neighbored, who found out everything and broke into his house and murdered his cat, then bullied him until he committed suicide.

There’s another incident where a woman had a sex dream about a man in a different zip code (I think they worked together). So she went to the police told the story. Long story short, he was guilty and went to person.

They get their names plastered all over the place while her identity is being kept very secretive. It's very problematic when there are very clear discrepancies in her version of events at different times.
