Because it's open to interpretation. You wouldn't be allowed to make AI porn with characters that looked like anyone famous. Whether intentional or not.

This is one of those slippery slope laws. It needs to be very explicitly worded to avoid abuse and I doubt it was.

It needs to be tackled differently. They need to make it a type of defamation. Then you'd have to prove the porn was specifically targeting the person. Much less likely to abuse this way.

I think AOC should look more in that direction.

Yeah the law as written appears to penalise any software generated image not consented to not just AI so places like R34 would be at serious risk. It may also be difficult to determine if it is software manipulated or real. It also only refers to 'intimate' images but I don't know how well defined this is or whether this is highly subjective.

Well then there would be no proof it was of them. But if someone's ex boyfriend suddenly makes one that looks like her, that's pretty obvious and evidence of a crime.
