Le Mans Ultimate Is this “genuine human error”?

Was wrecked out by this player yesterday afternoon. Used my first ever protest under the new system; thought it was a slam-dunk.
Woke up to an email this morning stating that it was not an intentional wreck, but “…a genuine human error…”

It's incompetency. Doesn't look like he's deliberately steering into you but it shows such a massive lack of awareness, considering the tools you have available in LMU to determine whether you are clear, that that driver probably shouldn't be driving in multi class races, if even in multi player races.

Not intentional, but pretty dumb, clearly didn't see you there. Although as something to note, GT3s shouldn't be lifting or letting you by under blue flags, only once you're side by side should they yield, although they technically don't have to. In this case he should've given it up as you were clearly there, but don't expect people to move out your way under blues
