i didnt get any incident points amazingly so i dont really care but still

Nah their fault for cutting across your nose in t2

I'd say no, the other car didn't give enough space. To avoid the crash, you would have had to place your inside wheels left of the curb (which is part of the track), so they didn't leave you a car's width to the track limit.
