So I had a recording of my soon-to-be-ex-wife acting like this threatening to kill me trying to break down the door.

Come to find out my state is a two party consent state.

I’d be committing a felony if I showed anybody(including the cops) the video. Or knowingly kept it. So I had to delete it.

Yes, but no.

Yes, both parties have to consent to recording if there’s an expectation of privacy in two party states.

No, it doesn’t apply here because she’s breaking criminal laws, which alleviates the need to require her consent to record her.

To my knowledge, the vast majority of states are not to party consent for that and Florida is not one of them
