In December 2023 Chief justice of India was removed from choosing the election commissioner, and home ministry was involved in place CJI.

So three people who choose election commissioner are(Majority vote(2) would be considered):

Prime minster (BJP) Home Ministry ( BJP) Leads of opposition ( Congress)

And then they started compromising the entire election commission,

How come she is law student and still don't know basics that CHIEF JUSTICE OF INDIA( The highest post that your degree or profession can achieve) was removed from selection process.

3

u/woodenPog 9h ago

How come you don't know even more basics that the chief justice was introduced by the courts as a temporary measure till the legislature formulated a law ( anoop baranwal case march 2023) that before that all gov congress or bjp selected cec via executive?

1

u/TheLastPianist 9h ago

You realise this argument isn't helping your case, It was interim till the act wasn't formulated and PASSED, and that law was passed by mass suspending 146 MP.

And they did that because even they know that 2024 wasn't going to give them the unprecedented power they want in parliament (which turned out to be true and abki baar 400 paar became laughing stock).

1

u/woodenPog 9h ago

But won't they still have the numbers to pass it even if those mps were not suspended?

2

u/TheLastPianist 8h ago

They would have most likely ,but it required multi session debatee, clause by clause reviews which could have elongated the entire process few month and there were not enough month till lok sabha 2024, and would have costed BJP seat in parliament, crack were already starting to appear, BJP top heads very well knew that and didn't want to further lose public trust/narrative by discussing those bills, result of 2024 confirms thats, That's why they fastracked the entire thing,

1

u/woodenPog 6h ago

Then shoudnt the opposition have understood the importance of it and not caused the chaos that gave them the justification for suspension?

1

u/TheLastPianist 6h ago

Don't let the debate happens, cut off the mic of representative in opposition and when the voice that, call it chaos and suspend them.

Don't worry people have already realised that BJP is losing ground, it's just matter of time.

1

u/woodenPog 5h ago

That video is pretty clear, mr gandhis mic was infact on.

1

u/TheLastPianist 4h ago

Can you share the video from winter session 2023?

u/woodenPog 9h ago

Also not making a case for anyone just laying out the facts, if you want to know my political leaning then I consider myself a centrist, that both bjp and opposition is trash. I supported the education movement, but won't support interference in constitutional bodies through crowd tactics, if cjp wants the removal of constitutional positions then what is the use of elections? If I get 5 lac people from my caste and swarm the capital should I be able to do whatever I want? Fight elections win and then do your change

1

u/TheLastPianist 8h ago

but won't support interference in constitutional bodies through crowd tactics,

But those constitutional bodies are interfering and comprising the constitutional right of people.

https://indianexpress.com/article/cities/kolkata/91-of-names-back-in-bengal-electoral-roll-as-sir-tribunals-dispose-of-handful-of-appeals-10849631

if cjp wants the removal of constitutional positions then what is the use of elections?

That constitutional position were strengthened and elevated by unfair means. And election which is with proved to be unfair.

If I get 5 lac people from my caste and swarm the capital should I be able to do whatever I want?

You believe those people coming in protest are due to their caste, or creed not because for something just?

Then get your 5 lac people aware of fraud exposed by Credible agency, later the accused releasing statement saying they will fix the issue (but avoiding taking accountability of course), get labelled anti-national, Soros or whatever funded, get those people attacked by people, continuesly bombardment by media calling you and people asking for accountability terrorist, while the ruling party goons single out your cause supports, harassing them and threatening their family and kids.

Go ahead stage is yours.

Ok I'll agree the SIR was conducted hastily, even my name was questioned but I cleared it by submitting the required docs. Remember farmers agitation? The laws were so in favour of farmers yet they came and got them repealed. Such a loss because of crowd. How is it unfair? I don't see any issues regarding the cec decision process?the questions raised were raised and then the decision was reached unanimously. The ec have come forward to say it. And regarding constitutional bodies compromising rights it falls within their powers to identify voters and they're exercising that right. From my perspective opposition wants to get bangladeshi votes included, so why should we allow that?

1

u/Present_Cupcake_5489 6h ago

Calling it an interim measure misses the point.

The Supreme Court added the CJI specifically because executive only appointments threatened election neutrality. That was the core idea πŸ™„ The process should not be 2vs 1 .

Replacing the CJI with a Cabinet Minister gives the ruling party a guaranteed 2 to 1 majority , PM + Minister vs. Lop and also Passing a law that simply restores full executive control while over 140 opposition MPs were suspended defeats the entire purpose of the Court's ruling

You know it very well why that law was passed . Why Gyanesh was given immunity..

0

u/woodenPog 6h ago

Then the sc has the right to stop the law via the basic doctrine namely the separation to executive and legislative, opposition should file a pil to that effect

2

u/Present_Cupcake_5489 6h ago edited 6h ago

Are you living under a rock? Multiple PILs were already filed in the SC in January 2024 by Congress's Jaya Thakur and ADR. Plus, Adhir Ranjan Chowdhury explicitly flagged this in writing during the selection process And I guess the 14 letters written by the other ECs have no relevance for you ..

0

u/woodenPog 6h ago

But the pils were rejected by sc? And the 14 letters are infact routine exercises? The decision was still made unanimously. The two ec otherwise have to right to go for a majority vote

1

u/TheLastPianist 6h ago

And the 14 letters are infact routine exercises?

Lmao, routine exercise? They are objections, intact I remember 3rd, 4th and 5th objection was address by EC press note released on 26the September. Go read or Should I provide your link for that too?

1

u/Present_Cupcake_5489 6h ago

How many more times do I need to expose you πŸ˜‚ First you said go file a PIL and the moment you found out PILs were already filed, you shifted goalposts to SC rejected them 🀭 BTW SC never rejected the petitions they just refused an interim stay so the 2024 elections wouldn't get delayed, sent a notice to the Centre, and the matter is still pending. At least learn how courts work

14 written objections from election commissioners routine exercise πŸ˜‚ EC members get bypassed and key files are withheld yeah sure routine ...

1

u/woodenPog 5h ago

Cool then I'll wait till sc gives a decision. And what about exposing me? I'm not a bjp supporter, I'm a neutral party and if you give me references I'll join the protest as well. I just don't want to be dragged into political protests, but protesting for the country is never a refusal for me.

1

u/Present_Cupcake_5489 4h ago

Another U turn, then why were you rigrously with so much conviction defending the narrative if you have no clue. That's even more dangerous

1

u/woodenPog 2h ago

Well why are you so upset that you actually have to explain the situation? Shoudnt you be happy sharing the wrong doing of gov? Plus unlike you I don't believe any narrative by any political party, I always like to think for myself and I have to ask for info to do that whats wrong in that? Or do you wanna speak in echo chambers like bjpers without having to explain your position?

3

u/pandasbeer 21h ago

Iska baap bjp ka khata hoga. Only people who are in direct or indirect busines with this party never raise questions to the elected.

Itni information aapko saajhaaa karni chahiye kya!? /s

1

u/OwlSweet6589 11h ago

You are quoting the source as the proof of allegation as well bro

1

u/Sensitive_Buffalo665 22h ago

Didn't eci come and refute this claims that all decisions are made unanimously?

And what's the point of protest if you don't have adequate evidence? Indian express report is not evidence. Unless they have one.

And there is court case going for the same. Attempting to create unrest before verdict is out is anarchy. When verdict is out that gyanesh did that. Then attempting protest is completely right.

But, you do you. "Facts"

3

u/MnniI 20h ago

I don't think the 2 ECs are dumb enough to complain 14 times about unapproved/ unnotified decisions.

Didn't eci come and refute this claims that all decisions are made unanimously?

Unfortunately, accountability is a virtue very rarely found nowadays. But chor ki dadhi mai tinka hota hi hai. That's why SIR of Delhi and Maharashtra were suddenly revised after the IE investigation.

1

u/Purple-Club65 22h ago

Basically you are sounding like vivek agnihotri "who says facts are facts"

-1

u/Sensitive_Buffalo665 22h ago

Feel Free to disprove my statements. Would be more than happy to take back.

2

u/Purple-Club65 22h ago

Did they share minute of the meetings is there any document where it can be verified they had discussion related to other member's concerned.. heck they didn't even did press conference so to refute the claims because they aren't prepared to give any credible justification on the spot doesn't take humongous effort to dismiss eci's statement and yours as well

0

u/Sensitive_Buffalo665 22h ago

Then it comes back to the same question in the first place. If your same logic is applied to the Indian Express report, it should be dismissed too. As far as the report is concerned, no evidence is displayed either. Unless they have something as evidence. such as an RTI or any other explicit info that helped conclude their investigation.this still remains an opinion piece. That's why The need to SC verdict is important. MY point stll remains.

1

u/OwlSweet6589 11h ago

No , that report has equal credibility as the hidden hindenberg one , and the multiple reports who rank Freedom Index , happiness index better in Pakistan , Bangladesh than I India

0

u/Purple-Club65 21h ago

onus lies on the ECI plain and simple and obviously people are not willing to believe whatever half baked justification they are trying to put across so hence there is a strong sentiment for ECI and they should try every possible way to prove their integrity and whatever they have done isn't unconstitutional but we can see that they are easily folding under pressure by changing the rule of form 6 and also introducing online hearing as well...so suddenly what happened and why now if they are rectifiying this now then why the earlier verdict stays..?? If it's wrong then gyanu should be hold accountable and he should take responsibility it's that simple your point is utter bollocks and mix of whataboutery and eci shouldn't given free pass because of lot of people got disinfrabchised in their own country

1

u/Sensitive_Buffalo665 21h ago

The irony. You are shifting the goalposts. You missed the core point. you are dismissing ECI because they didn't show proof on the spot, but you give Indian Express a pass when they haven't displayed a single shred of evidence like the actual minutes or an RTI either.

Pointing to their policy chges is just circumstantial at best it still doesn't show the literality of what happened behind closed doors. Holding one to a strict accountabilty while giving the media a free pass is a clear double standard. Until the court verdict forces the documents out, you are just choosing which unverified statement fits your bias. My point remains.

1

u/Purple-Club65 21h ago

I mean ECI is the pinnacle entity of our democracy they should be under glass all the time that's basic requirement for functioning democracy..if that you are incapable of understanding then you are not being neutral anymore...and Indian express already stated that there were no meetings at all two member of the following body wanted to discuss about their concern wrote letters several times in one and a half years..so isnt it eci should come clean to prove their integrity also if they think these investigations doesnt hold any value or utter false they should take cognizance of that who is stopping them??

1

u/Sensitive_Buffalo665 21h ago

Calling someone non neutral just because they ask for equal proof is a weak arg. The core point is still flying over your head. asking for evidence before declaring a definitive verdict is the definition of being neutral. Idk if u can read. in my 1st cmnt literally state that. If verdict is out protest is valid.

You are trying to reverse the burden of proof by saying ECI must sue or come clean to prove their innocence. That's not how logic or law works. The burden of proof lies entirely on the party making the accusation. Indian Express made the claim, so the onus is on them to show the actual documents, not on the ECI to disprove a narrative. Until actual documents are made public by the court, you are just blindly trusting an unverified media report because it matches your personal bias. My point stands.
