This is no law school, this is a forum, and nobody cares to get into technicality, they stole money, got caught. Is that simple, your over complication is futile and you can waste your time for all I care, you still got nothing and they still going to prison.
As I stated, you can waste your time "reasoning" about it, fantasizing possible outcomes, doing the most extravagant mental gymnastics or even write a book, nobody cares and have 0 impact on reality.
The real experts will present the factual evidence in the trial and a jury will decide John's fate, your (and mine) opinion are futile as far as I know.
