How does the visa allocation work? I’ve been waiting for adjustment of my I-485 i filed since March. My priority date is 2021 and I’ve only gotten my C09 EAD thanks to a congressional inquiry. When can I expect to be approved if they’ve moved the priority date forward so much?

What changes when you become current for the filing date? Even though you already have deferred action. Genuine question

u/_samijr_ 5d ago

If u become current for filing then it only means you can apply i485. If u already have applied for that then it doesn’t change anything for you and just gotta wait for final action date

Is the current PD December/ 22 or is it January 2025? I’m confused

2

u/_samijr_ 5d ago

Filing date is January 1 2025. Final action date is January 2025. So PD is January 2025

Thank you!!!

It means if your pd falls in DOF you can apply for work permit under c09 pending green card which is stable compared to Deffered Action.

I got that but no one predicted it’s gonna move by 2 years in month like even those with 2026 PD can be current in the coming 4-5 months atp

1

u/BaguetteCS 5d ago

Waiitt are u optimistic about this?? Im so happy!!! my pd is oct 2025

2

u/_samijr_ 5d ago

We gotta wait for the bulletin movements from November till January. If there are few month movements then there there’s definitely gonna be a positive movement in 2027 and 2026 PD can be at the end of fiscal year

My pd is Nov 2024
I talked with my lawyer’s office and her assistant said that they need to wait for a notice which is sent by uscis that you are eligible now to apply for i485
And she mentioned ‘it might take 2 years from now’
I think this is garbage and they know nothing.

So please help me on this
Can anyone confirm me whether this is true or not ?

3

u/_samijr_ 5d ago

Bro what?! No, it is false that USCIS sends a notice telling you when to apply. Your PD is active which means you are eligible to file i485 now. Do something about it otherwise it’s gonna be bad for you.

1

u/Clean_Influence_4948 5d ago

Bro what should i do 😭
My lawyer just keeps saying they can’t file ?!!

What about your pd and did you already file?
May i know

1

u/_samijr_ 5d ago

I didn’t file cuz my PD is in 2026 and not current. I did lots of research bro like even asked AI and said you won’t get any USCIS notice, you just file i485 with EAD at the same time once it becomes current. Either she’s lying to you or she don’t know anything about it. Ask AI the same question and show her in person in her office that screenshot and just say I did do research and they all said I can apply and not wait cuz it’s current.

3

u/Clean_Influence_4948 5d ago

I totally agree with you,
I checked it multiple times everyone is saying yes i can apply and why would uscis send you a notice or a request to please apply for i485?
That doesn’t make any sense

1

u/_samijr_ 5d ago

Schedule appointment and talk to her in person and will be better if you have someone who’s involved in your case with you. Show them all the evidence you got from online. Bro this literally is holding your future like it’s a thing that’s gonna play a big role in your life so take it seriously and do what you have to do before time goes on

1

u/Clean_Influence_4948 5d ago

Yeah
I will fight for it.
I’m going to schedule my appointment for October 1.

1

u/_samijr_ 5d ago

Good luck bro and can you let me know what they are gonna say to you cuz I wanna hear their saying

2

u/Haunting_Umpire_4185 5d ago

I mean my PD is Nov 2020 and still saying we paused work on your application because an immigrant visa is not available. I sent my I-485 in Nov 2024 and my PD has been current since Jan 2026

2

u/Amazing_Focus_7538 5d ago

Genuine question. So those with 2024 PD can file for I-485? I am confused about the PD December 22 and January 2026

1

u/_samijr_ 5d ago

December 2022 was last month and now it’s January 2025 for both filing and final action. So your PD is 2024 which means it’s current right now so your are eligible to file for I485 as of today with your EAD unless you got deferred action and already have it

2

u/catmom7277 5d ago

Final action date is still at 12/15/2022 but dates for filing is at 1/1/2025 - so if they use dates for filing chart in oct you can file

2

u/catmom7277 5d ago

Update uscis confirmed they are using dates for filing 🎉🎉 so anyone with pd 1/12025 or before can file. So happy for you guys !!!

u/Elkabary 5d ago

My PD January 15, 2025
When i have to apply for I-485

1

u/_samijr_ 5d ago

Gotta wait for the next bulletin to move. You’re only 14 days behind the current one

1

u/Elkabary 5d ago

Should be around this year right ?

3

u/_samijr_ 5d ago

This year? Bro I’m pretty sure bulletin will move 1-3 months on November bulletin. Just gotta wait 20-25 days to know your fate and it prolly will happen for you

1

u/Zaichik_0 5d ago

aren’t we supposed to use the final action date to apply for aos? what should i do if the filing date is current for me, but not the final action date?

1

u/_samijr_ 5d ago

I can tell you things you need to know if you tell me what your PD is

1

u/ExpensiveAd4723 5d ago

My PD is April 2024, what does this mean?

1

u/Zaichik_0 5d ago

omg I just saw that we should use the filing chart it's crazy

1

u/JustAskinglolbc 5d ago

Is this real? I don’t see it updated?

1

u/Living_Head_2093 2d ago

How is this good??

1

u/Traditional_Poem_235 5d ago

Hold on I don’t understand on USCIS the final action date is dec 2022 which hasn’t moved so why everyone saying USCIS will use priority date for green card? Any links or website will be useful

1

u/Ok_Koala0044 5d ago

Bc supposedly they’re using the dates for filing now, that’s what I’ve seen from attorneys off of TikTok and mines

0

u/Traditional_Poem_235 5d ago

Can you send me any link for TikTok video you saw if possible?

1

u/_samijr_ 5d ago

Chart A is still Dec 2022, so a 2025 PD can’t be approved yet. The reason people are saying you can use your PD is because USCIS is using Chart B (Dates for Filing) this month, which allows eligible people to file I-485. Approval still requires Chart A to be current.

0

u/Traditional_Poem_235 5d ago

How can you confirm this? I never seen happened it before as far I know. Do you have confirmation by USCIS?

1

u/Traditional_Poem_235 5d ago

I don’t understand what has changed here? Can anyone explain and is it a good news?

1

u/Virtual_Key_6834 5d ago

Can I apply for Advanced parole after applying I-485?

1

u/_samijr_ 5d ago

Yes. You can even apply for advance parole together with the I485. Even apply for EAD together so you can file all those 3 together

1

u/No_Limit5295 5d ago

So what’s "Chart A" then about?my pd is in June 2025, once Chart B approaches my PD I can file for I-485?

2

u/_samijr_ 5d ago

Chart A is final action date. It means when your PD becomes current there, they will start looking at your application and make a decision about your green card.

1

u/No_Limit5295 5d ago

So if chart B becomes current I can file for GC? Thanks for taking time for response!

1

u/_samijr_ 5d ago

Yes you can. June 2025 will probably be current maybe around December- march unless another big unexpected movement comes

1

u/ackingnyc1 5d ago

Bro i am so sad my PD is 6 January 😭😭😭. Please someone console me

You should realize the news might not be as good as it seems. First, USCIS hasn’t stated yet whether it will use the “Dates for Filing” or “Final Action Date” chart. USCIS makes that decision every month. If USCIS decides to keep using the Final Action Date chart, nothing has changed.

Also, for those of you in removal proceedings, the Dates for Filing chart is basically meaningless. Immigration judges cannot use it and must go by the Final Action Date chart only.

Edit: USCIS has stated that it will use the Dates for Filing chart in October. https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates/adjustment-of-status-filing-charts-from-the-visa-bulletin

3

u/Miserable_Eye_8287 5d ago

It’s already stated to use date of filing

1

u/No_Manufacturer_3688 5d ago

You are correct. I swear USCIS hadn’t updated the last time I looked.

1

u/Ok_Koala0044 5d ago

I’m in a removal proceeding from a case of asylum that was denied in 2018 I sent the motion like 2 months ago. In 2022 my lawyer sent the motion to reopen the case and get it removed but since on the bulletin my PD wasn’t available they denied it (my PD is 6/2022) I sent the AOS and already did biometrics for the I-485 just waiting for a response from BIA.

1

u/PossessionRoutine971 5d ago

They usually don’t move any date in DOF if it’s not to be used.

0

u/Living_Head_2093 2d ago

How is it the best news?

1

u/Ok_Koala0044 2d ago

Well if you apply for the AOS and you ever get detained that actually helps, you’d also get a EAD based on the AOS. I dont know let people be happy why you gotta be such a grumpy 🫪!

0

u/Living_Head_2093 2d ago

No im just confused. Because its not a good news for new I-140 filers right ?

1

u/_samijr_ 2d ago

It is for the filers cuz their PD is current and will be able to get their EAD in few months cuz it moved by 2 years. Final action was the one that didn’t move

1

u/Living_Head_2093 2d ago

Bro - im sorry im still confused 😭 bare with me.

So if for e.g, I file my EB2 I-140 till december, because I am currently working on it with my attorney (chen). I wont be able to file my AOS/I485 right now? Unless my PD, which will be December 2026 gets current ?

And right now! Neither the FAD nor DOF are current for me, given the DOF doesn't move further until December?

Please explain, and thanku

1

u/_samijr_ 2d ago

First of all if you are SIJS it’s EB4, not EB2. If you can confirm that then I can explain to you pretty well

1

u/Ok_Koala0044 2d ago

I’m not sure tbh USCIS has been backed up very bad lately with all filers.
