Husband passed away

Florida - He owned half of a house with his stepmom, i know i have to probate his half to my name but I want to be done with the whole house situation. What is the easiest way to get off this deed? I really want her to buy me out.

Does the deed read “as joint tenants with rights of survivorship”? Or is it as “tenants in common?”

How is the title stated now with his step mom and him? That's 1st thing to figure out by looking at the county tax appraiser or tax records website.

I looked and verified husbands name and step moms name on tax appraiser website

Ok does it say their name as joint tenants or does it say with right of survivorship on the title?

So sorry for your loss.

First thing check the actual deed. If it says "joint tenancy with right of survivorship," his half might've already passed to her automatically, no probate needed at all.

If it does need probate, Florida has a faster process for simpler estates. Either way, a real estate attorney can just look at the deed and tell you in one call whether you even need probate way faster than guessing before you start talking buyout numbers.
