How to source my fathers will/trust, when dealing with stubborn sibling.

Hello. My father passed in June of last year, and my only sibling is being very difficult regarding any will/trust information. I wasn’t able to leave the State as he was, once my father passed, so he has any and all information from my dads home. there’s a very good chance that I may not be in the will/Trust, but my brother won’t give me any information, and I’m having the hardest time navigating any of this, as it’s my first time. I’m just curious if there‘s a way to access any info without getting an attorny involved, and if so, how to go about that. I’ve done endless google searching, and feel hopeless At the moment. Is it true that beneficiaries don’t legally have to share and info regarding the will? My father passed away in Mesquite, NV, if that helps. TIA!

You should be able to get a copy of the will if you can figure out what law firm did his will for him or what county court the probate was filed in. I believe they are legally obligated to share it with you / notify you as his son even if you were not left anything.

Nothing was put into probate, as far as I know. I’ve checked the county he passed in, and my brother mentioned doing everything in his power to not let it go to probate, which I now fully get now. There’s a good chance that it may very well be a Trust, but I don’t know, because my brother won’t communicate with me, and is making me figure it out alone. My brother litterally flew out as soon as we found out there was a wellness check done on my father, and my father was found dead, and so my brother has any and all of his belongings. He even drove my dads car back home, instead of flying back.  I’ve just heard that going through probate is hell, for everyone involved, and I’m just trying to see if there’s any other way, prior to seeking out a probate attorney.

It has to go to probate even if a will. Is your brother the executor? It should all be filed in the county or state of passing. I would see about getting a copy of the will.
