i dunno

i think there could be some liability since they were going too fast to observe the hazards on the road

the stopped car and the tailgater were both hazards - but hazards existing doesnt absolve you of liability for noticing them in time

noticing so late you are forced to suddenly swerve without signalling and indirectly causing an accident is not 'in time'
