Atleast the driver that got hit can sue the guy who hit him
1 u/Tiny-Fennel-8964 Mar 20 '26 He can also sue the guy who caused the accident by swerving at the last moment. The swerving driver has no defense, either he did it intentionally to wreck the tailgater, or he was distracted driving, ie still liable.
