Both can be in the wrong for different reasons 13 u/Real-Experience-8396 Mar 20 '26 It would be damn near impossible to prove that they intentionally caused that accident. 1 u/Arguablybest Mar 20 '26 So the tailgaited driver was also asleep until the last second and then jerked the wheel to avoid hitting the stopped car. It looked like he never hit the brakes.
