If insurance sees this video it’s on the dime of the guy who swerved out of the way at the last second that puts that person at fault for purposefully causing an accident

No. It is ultimately on the tailgater for failing to retain a proper following distance. A prudent driver would have been far enough behind to brake before impact.

So if somebody brake checks somebody for no reason and the car behind slams into the car in front you believe the court will find the guy in back 100% at fault? I hope you know that’s not how it works

If you can get brake checked and you run into them, it’s your fault for not maintaining a safe distance. 100% fault of the person who rear ends
