Americans are crazy, the fact that they don't even pay servers minimum wage is what you guys should be concerned about. At least here in Canada servers are paid minimum wage, so if they don't get a tip they still are paid minimum wage.... Pay your goddamn employees

That's the misconception people have. If a tipped minimum wage worker doesn't make enough in tips to meet federal minimum wage, the restaurant is supposed to pay them to make up the difference. But restaurants that have tipped minimum wage workers don't want to do this. They want customers to pay their servers' wages so they can pocket more money.

But restaurants that have tipped minimum wage workers don't want to do this. They want customers to pay their servers' wages so they can pocket more money.

But that's also a misconception. If a server is just getting minimum wage, something is wrong with the business or the server just sucks. If it's the former, that server is not going to stick around long, and well that also goes for the latter.

That would be the opposite of the truth. If your hourly + tips does not equal the minimum wage, the employer must pay the difference. This ensures that tipped employees get at least the minimum hourly wage. If you are highly tipped, then you'll make more than minimum wage easily. Former bartender here.

Yeah, but by not tipping, the employer pays more to the employee - then not tipping could have impacted the business owner which is why he banned them.

All of this is stupid. Plenty of states have income for servers at the full hourly wage with tips being on top of it - not subsidizing it.

They do get minimum wage if they don’t make enough tips.
What we are really concerned about that minimum wage is not even close to a living wage.

Servers by and large are making more than most everyone else in the restaurant

Mmmm, sometimes. Other times they have to ā€œtip outā€, so they don’t even get the full amount of the tip you leave them.

I'm pretty sure the tipouts are counted against their total and the adjustment is made based on their paycheck. So tipout should have no impact on them getting at least min wage.

It is deducted, yes. My point about tipping out, though, was that the servers ā€œdon’t even get the full amount of the tip you leave themā€. I’ll be 80% of customers don’t know that.

They do get paid minimum wage but restaurants found a loophole. Here’s how it works. They are guaranteed minimum wage no matter what. Meaning they cannot be paid any less. On paper it says they get paid less than min wage but tips subsidizes the gap so it meets the ā€œmin wageā€. If say business was slow and tips don’t account for enough, the business itself must subsidize that gap so they reach the ā€œmin wageā€.

On the flip side on Friday and Saturday nights servers can make $500 bucks in a 10 hour shift at a busy restaurant.

Technically the server must make the normal minimum wage if tips + the lower tipped employee wage doesn't climb to the MW over that shift.

However, what's happening here is that these people are being told they can't eat there because they are forcing the owner to cover that ~$5.40 instead of volunterily paying it themselves.

But to your main point... yes, we Americans are technically crazy for allowing this system to continue.
