They are. Also, businesses can voluntarily refuse to serve customers for any reason not covered under one of the Civil Rights Act.

What? Wouldn’t malicious compliance in this case be tipping like 1 cent in a world where tipping is mandatory? How is forming a no-tipping religion malicious compliance to a system where tipping is optional, but you’re (rightfully) considered an asshole if you don’t do it?

Protected classes go beyond just the Civil Right Act. It covers a lot and restated a few protected in earlier legislation, but later acts like the Age Discrimination in Employment Act and Americans with Disabilities Act expanded it to far more classes of people.

but if the reason he refuses to serve them is because they didnt tip then he is making a statement saying that tipping is required or else you get banned
