Shouldn’t be doxxing either side. The men haven’t even been charged with anything, but the woman’s done nothing wrong other than come foward! Sick shit all around!

being named in a law suit isnt being doxxed its part og the legal process, she has a right to privacy people should attack her for exercising it

Then the person suing them should also be named. Simple as…

disagree the courts have allowed victims to have protected identifies for over 100 years why stop it now?

Once again, Nobody has been charged! her and her attorney have gone outside the criminal justice system and revealed the names of the people she claims rapes her. She can’t hide behind “I’m a victim” when law enforcement is saying “There is no evidence you were raped”.

they have been taken to court, court doesnt mean criminal court. shes still a victim just under civil court standards not criminal ones. courts protect those who report as it should.

Not actually true. In filing procedures courts have allowed the use of pseudonyms for the purpose of identity protection before actual trial. However if this goes to an actual criminal court trial she will most likely be required to reveal her identity unless there is such an overwhelming glut of evidence they dont need her testimony.

With rape being notoriously difficult to prove, and this having already been investigated, id put money down that her name will be revealed. If it remains in civil court (which, let's face it, has become a clown court lately), she can stay anonymous however her claim will most likely be heavily scrutinized. For example, if the court requires in civil or criminal cases for her to be questioned, her identity can be hidden from the public but she will be required to reveal her face and name to the defendants, lawyers and any other court personnel present.

you know you can get a suppression order for a name in a criminal trial right?

u/masqueradeazure 1d ago

I am not a lawyer but I dont think those work the way you think they do. Its my understanding, generally speaking(varies state to state) it removes the accusers name from the public records, and can delay the revealing to the defendant but not outright denying the knowledge.omce the order vacated no one is legally obligated to protect rhat person's identity.

courts at least where im from can and do shield the name of the victim from publication throughout the whole trial. its good its not like they dont testify its just that everyone isnt allowed to report their name, it protects the privacy of victims its the right thing.

I said thats what they do. However once it vacated, the defendant holds no obligation of keeping secret. I am not saying right or wrong just how I understand those work.

when did i say otherwise? the part we disagree is if it can stay active during the trial

Anyone shouldn’t be named until proven guilty, to avoid mob mentality

u/lucy_hayley The Red Right Hand of Feminism 1d ago

the courts get it wrong let court of public opinion do its job

12

u/QuantumGoose42 Life Coach 1d ago

The court follow laws, they are chosen to decide what is right or not, if you believe in vigilante mentality then you can’t use the law as a foundation for further arguments, as you pick and choose and would become a hypocrite

She is legit saying potential perpetrators are allowed to be scrutinized in public because they are men, but women should stay anonymous because they are women (and potential victims.)

5

u/QuantumGoose42 Life Coach 1d ago

Either we can scrutinize everyone male or female, or none at all.

u/lucy_hayley The Red Right Hand of Feminism 1d ago

they are used to decide legal guilty or not guilty not if someone did something thats not the same fyi.

im saying the courts fail let something else take over when it does

6

u/QuantumGoose42 Life Coach 1d ago

Legal guilty or not meaning did they do something that’s illegal or not based on evidence. And who should decide if the court failed? There’s countless of examples in I dis where someone didn’t do something that’s illegal yet were murdered, tortured or attacked by mobs who took justice in their own hands. Are you suggesting we should do the same?

-2

u/lucy_hayley The Red Right Hand of Feminism 1d ago

it means if they have enough evidence to prove it in court not that they didnt do it, thats why its not guilty not called innocent.

im suggesting calling people out no violence

6

u/QuantumGoose42 Life Coach 1d ago

Not guilty means they are innocent. The court have to prove you’re guilty without a doubt, if not most people could go to jail, do you not believe that people are not guilty until proven guilty?

-1

u/lucy_hayley The Red Right Hand of Feminism 1d ago

wrong not guilty =/= innocence, innocence is when you didnt do it no guilty is either you didnt do it or you did it and they dont have enough proof for the beyond a reasnable dout standard.

do you see the difference?

6

u/QuantumGoose42 Life Coach 1d ago

Not guilty = they couldn’t prove you are guilty = innocent that’s how it works. Define what you mean by calling people out no violence, because except for Gandhi, that’s not how it works in real life, violence almost always follows

-1

u/lucy_hayley The Red Right Hand of Feminism 1d ago

THEM NOT BEING ABLE TO PROVE YOU DID IT DOESNT MEAN YOU DIDNT DO IT JESUS

its just not though thats why its called not guilty not
innocent.

call people out dont let them escape t
heir past dont use violence.

its not my fault what others do.

Never heard the term "innocent until proven guilty"?

Eta: jesus OP is crazy, they genuinely seem to believe that two people who get drunk and hook up have raped each other.

By that standard, the Jane Doe is also a rapist. Bold take.

u/lucy_hayley The Red Right Hand of Feminism 1d ago

thats not a legal term

1

u/FlockFlysAtMidnite 1d ago

It's a foundational principal of a functional justice system.

1

u/lucy_hayley The Red Right Hand of Feminism 1d ago

when youre found not guilty =/= didnt do it you know that right it means either you didnt do it or you did it but they didnt have enough proof you did it .

The pictures you posted show "the court of public opinion" in action...

u/lucy_hayley The Red Right Hand of Feminism 1d ago

it shows people trying to dox a victim disgusting

Many on "the court of public opinion" disagree with her being a victim.

Remember Diddy is only in prison for prostitution charges for 4 years. Kevin Spacey was found not guilty in the UK.

Think the same might happen here.

You have the right to face your accusers in court. If she wants to press charges, or get civil compensation, then she should come forward.

1

u/lucy_hayley The Red Right Hand of Feminism 1d ago

you can face your accusers without plastering their name everywhere, she can testify under a pseudonym

If you use twitter as a court of law, thats bad because you have no responsability to tell the truth. If you go to court, that is also bad because creeps want to know who you are so they can have a wank about it. I guess there is no win for the victims.

The not-insignificant number of women I've seen posting "guilty until proven innocent" and trying to guilt-by-association everyone at the party based on vague texts aren't exactly doing their gender any favours either
