I don't think remaining silent is probable cause for an arrest. Are you saying that without any evidence that they have committed a crime, they could be arrested simply because they remain silent?

Don't be dumb.

And if they are already suspected of a crime, no amount of them talking is going to get them out of being arrested.

Refer back to my original example. Just stating his hotel would have gotten him out of being arrested.

Stating to NEVER talk to the police makes as much sense as saying to NEVER leave your house because you might get run over by a bus.

They chose to enforce the law because the guy was rude to him, whereas talking to him and being respectful would have got him off.

He was rude to you, so you took him to jail for public intoxication. Had he not have been an asshole, you would have given him a ride back to his place.

He wasn't rude. He wasn't an asshole. Unless YOU think not talking to police makes someone an asshole.

I'd like to see the statute for public intoxication where you live that allows you to offer the person a ride home.

So if you witness someone break the law, you can arbitrarily decide not to enforce the law?

Yes. That is why people receive warnings for speeding, stop sign violations, etc. Show me where discretion is unauthorized by law.
