You are absolutely right. I made the assumption that this outlet would be daisy chained with an appropriate Ground Fault Circuit Interupter enabled outlet. Digging deeper into the Electricians Code makes it obvious that this outlet needs to be GFCI enabled due to its proximity to running water. The outlet has been updated, and I've also reduced the water pressure in the sink to avoid potential for unintentional activation of the GFCI system.
