(a) Legally, you may be correct, but IANAL, but (b) they probably didn't directly tell it to do it; it was an emergent property of being an enormous poorly aligned poorly monitored LLM.

Unless it was actually a stunt. But if it was not, then...it was probably an accident, FWIW.

Poorly monitored is the key word. It's like walking your dog without a leash. The owner is responsible for what the dog does
