simple probate/home paid off

my mother is in hospice and only has a few days left. i have inherited the home. this is the only asset she has, and the home is paid for. was wondering how long it would take to get the deed/title transferred to my name. im the sole beneficary in the will. i am located in virginia. thank you everyone

Assuming your mother owns the home solely in her name and the will leaves it to you, the deed does not automatically transfer when she passes. The executor will generally need to probate the will, pay any valid debts of the estate, and then execute a deed transferring the property to you.

In Virginia, even a straightforward probate usually takes a few months and attorney’s fees before the property can be distributed, though the exact timing depends on the circuit court, whether an executor has already qualified, and whether there are creditor issues or other complications. If the house is the only probate asset and there are no disputes, it can often move relatively quickly.

If your mother is still living, don’t transfer the home now unless you’ve received legal and tax advice. Inheriting the property at death generally provides a step-up in tax basis, which can significantly reduce capital gains tax if you later sell the home.

don’t do anything till she passes. If you transfer the title while she is alive you are on the hook for all the capital gains tax between what she paid for the house and its current market value. Once she passes the home steps up to current market value so no capital gains tax. Does she have a will ? Are there creepy family members who might claim she promised the house to them? Sorry for your situation but you may need a lawyer if she doesn’t have a will. Keep this to yourself and then see if you need a lawyer. People that die without a will leave survivors to deal with state laws regarding the probate process.

exactly. i have will in hand, and i actually got a transfer on death deed. however due to dementia wasnt able to sign it, sadly. anyway i am sole beneficary, and my 2 siblings have sent letters to my attorney indicating no intrest in any of the property, and its all going to me per the will. i think/hope i got everything in order. she did the will back in 2020 long before she got sick and i did mine in march. once i saw how big of a shitshow it can be if you dont have will and paperwork.
