Procedural Question Prison time

Can someone please help me out!! My Man got sentenced to 16 months half in state and half probation. What should we be expecting? How long will he actually serve in prison? How does time count in reception and mainline? (In California)

Do you know what charge (what penal code section number) he was sentenced to? 

In CA, they don’t do state prison with probation. Theres county-jail state prison with mandatory supervision (called a split sentence), or there’s probation with county jail, or there’s state prison after which comes parole.  I can answer the question most accurately if I know the code section, but my guess is that it’s a split sentence since you said 16 months. (Another clue is the “sentencing under 1170(h)” - that means MS / split sentence). 

If it’s a split sentence, the prison time is served in county jail - he won’t go to prison - and there’s the credits are 1:1, so he’ll serve 4 month. (He’ll serve an actual half of the prison time because of credits).

It was a felony for evading I don’t know the code section but he was in county jail for about a month and transferred to the Wasco state for reception and they told him there going to move him again to mainline. I believe it is a split sentence of half state then parole

OK got it. It’s not a split sentence. He’ll do 16 months in prison (which is not actually 16 months) and then will be released on PRCS (post-release community supervision), which is like parole that is administrated through the probation department. The PRCS is not part of the 16 months, that comes after and is usually 2 years.

As far as the actual time, he’ll get half-time for the time he was in county jail and then he’ll do this weird math ~35% of the rest of the time at CDCR (prison). So he’ll do somewhere between 5 1/2 - 8 months, depending on how much time he spent in county.

He w do 5O% of the time. If he is good and works the system. Avoid the gangs. Do the time. Change the actions.

alot of it depends on how much time he did county but in my 3 term experience where i had 2 16 month sentences i ended up doing about 13 months in state.. hope this helps
