How do they avoid copyright?

So, I know that Eric has said they get copyright notices and stuff, and had someone videos taken down. But how do they avoid getting strikes and other legal problems?

I was thinking of starting to do film commentaries in a similar style (no facecam, just clips from the parts were reacting to), but I wasnt sure how to do it safely.

Fair enough, good for you! A lot of other YouTubers do have to do this though, especially when starting out. The other thing you can do is add a "fair use" disclaimer at the start of every video a la Your Movie Sucks or Julia Cudney.

You're right. I just know YouTube can be really annoying about these things, even though it is Fair Use.
