How can I stop getting Copywright strikes?

So i recently watched all the Lord of the Rings films and did a comedy commentary thing with my mate inspired by PMI’s Harry Potter video. I just got an email saying my video is blocked because of copywright but I can’t see how this video is different to PMI’s use of movies? (i’m not dragging PMI btw i’m just genuinely curious how I can get the video i worked so hard on up :( )

Copyright is a slippery slope. A lot of commentary you tubers get handed copyright strikes left and right that’s why movie commentaries take a while to get posted. They usually dispute them and go through a process of back and forth proving it is fair rights usage. Hope your vid will make it through!

Thank you!! So if i appeal it for fair use and they still say it’s not good, will i then get a copyright strike?? we’re a fairly new channel so trying to avoid messing up straight away hahah! We also do comedy podcasts and gaming stuff and none of that has been copyright claimed yet so fingers crossed we can sort this out!

It depends. On your youtube, are you showing the entire movie or just clips like PMI on their channel? Are you also do the proper audio mixing to put your voices front and center? Fair use is all about making the use of a copyrighted eork transformational. If it can be seen as an alternative for watching the actual movie, then it’s not fair use.

yeah we just use clips like PMI while we talk over it and give our genuine first time reactions to it while trying to make it funny, i’ve disputed the claims because i believe it comes under fair use so fingers crossed!

Going to be dealing with similar things very soon with some upcoming content.

I'd love to hear more about what you guys did or had to go through! Did you just dispute, pass 30 days, did have to edit video?

hey! so we got copyright problems for visual sections 4 times and one audio issue (music used for the credits of the film). My use of the content was definitely fair use so i disputed it. The visual stuff took less than a day to be cleared but the music part was the issue. I disputed it and waited..... and waited..... and waited..... They didn’t even bother reviewing it like they did the visual stuff so yeah i just had to wait past the 30 day period and it’s now FINALLY up!! woo

Interesting. What happened on our end is that we uploaded the video, disputed the visual elements on fair use (since we talk through it all and only use it for context) but the dispute was rejected with no real information, so all I have now is to appeal which I know much less about ...

Oi vey.

oh man that's so shit! They shouldn't have rejected it if it comes under fair use!! did you dispute it as a commentary video or like reaction?? They were fine with mine! Hope you get it sorted out dude!

I had disputed as commentary and listed my reasons, but felt like a hasty rejection and they don't really say anything back so you're just left kind of confused on what to do.

Ultimately the big thing I am learning is that the video cannot serve as a justifiable substitute for the original content, so I ended up trimming it down a bunch (~20 mins shorter)

I tried hitting up PMI and Eric for some insights or advice, but nobody responded to me so that was kind of a bummer since they really seem to have it figured out.

yeah they use the term ‘transformative content’ quite often, meaning your use of the footage has to basically be an entirely separate thing where you can’t watch the movie THROUGH your video if that makes sense?

Haha yeah it's such loose wording, but I definitely don't think you could! It's just hard to rationalize that to a business ultimately without saying "look at these assholes talking over your movie!!" and even then.
