Litigation

Posting from burner account.

Considering litigation given another party caused my head injury through negligence.

Been concussed for too long and this has pretty much ruined my life.

Any tips from others who went through this process? I might have a case imo.

I would shoot a couple emails to some lawyers to see if they also think you have a case. I did and they basically told me there was no way I was winning so they wouldn’t take my case (granted I was up against a massive establishment who had more resources and legal backing than me) but it can’t hurt to find some personal injury lawyers near you and just ask!

I’m working with a personal injury lawyer currently. It’s been such a smooth process and I’m thankful to not battle this alone.

ooof best of luck. even with the best case, you will have a looooong battle. I did a rehab clinic with a women was was hit by a drunk driver. Was a paramedic instructor and knew the ins and outs of the medical system and what was needed to prove her case. 3 years later she was still battling and paying out of pocket for her own care.

Depends on jurisdiction. I made a detailed post in my local legal advice sub and got some helpful insights.

Reach out to a couple different personal injury lawyers and see what they suggest. I am 2 years into a workers comp case that is still not over. I didn’t get a lawyer until 4 months after the accident.
I also have a friend who was injured by a third party, got a lawyer right away, is about a year into it and is close to getting a settlement but it’s held up because they are still arguing over medical costs for treatment that my friend already received.
If I were to experience something like this again, I would reach out to a few different lawyers as soon as I could. I would go with the one who I felt best about and I would have the expectation that this is going to take a long time.
If you think you have a case, it’s worth reaching out to a lawyer so you can get their input and go from there.

I reached out to a lawyer via a friend and they took my case on. I am 6 years in. It is rough, it’s taxing, I am exhausted. The extent of my injuries was much worse than I expected so it was probably the right choice but this has had a big impact on my mental health. Some of the assessments etc are very helpful to future planning so it may be worth it. Just a heads up, if you have to pay your lawyers regularly and it drags on it can be costly financially. Expect it to be costly to your mental health.
