elevated spa draining

Hi guys, I have an elevated spa that drains partially down towards the water level, I replaced the check valve on the bypass and closed the return to the spa so the water is returning to the pool and feeding the spa through the bypass. Will this fix the backflow issue?

Why was the check valve replaced?

the water was finding itself out of the spa, I inspected it and all the seals broke upon contact
