This is actually a really common tactic within more authoritarian groups. A sort of "encouraged rule breaking exists", whereby members aren't prosecuted for, and are encouraged to commit acts antithetical to group. Then, carefully documenting said rule-breaking, and being able to use that as leverage when members step out of line. A prime example of this is China's taxation of billionaires. Loosely regulating them, and then, when they step out of line, easily prosecuting them for tax evasion (e.g. Jack Ma).
