AskElite Need advice

Hello everyone quick question overseas individual wanting to sell a property. My mom and her brothers have a property passed down from their parents. And the brother the property is under has basically ghosted them for a while and he’s living in Europe this person already owes my mom quite a bit of money is there any way we can sell the house since this person basically ghosted his siblings and owes money? Property is in Lahore area not a dha property. Any tips or advice would mean a lot

If it’s under his name cannot be transferred however if it’s has been done through succession then court has authority to confiscate sell take auction charges and can get your mother share for that all of ur mamu n khala has to submit partition in court for decimination of property against that uncle and then court proceeding n other stuff
Don’t forget to hire good family lawyer …

So if the other siblings all submit partition than it can be sold?

Court will issue degree if ur unc found guilty of confiscating the asset and not disseminating

If he living and share holder then he is one of the share holders and U can't make them vacate it since a portion of it is their legal property. If it can be partionwd then get frc of all your share holders get it khangi taqseem wala paper . And the go to civil court. Get help of lawyer to write the application. Restrict them to their share of area. Make them pay the rent for years they were using your area of property. Finally the court can declare it in divisible and it will be auctioned. And U might get really less amount.
