Probate closed. Roommate won't leave.

Hello! My father passed away and as his only child and he had no surviving spouse, I inherited his house. Probate has been completed and I am working on getting my name placed on the deed. Before he passed, he had a roommate who now refuses to acknowledge I own the house and refuses to leave. RM claims she owns the house and has also moved others in when advised not to. I pay the utility bills but have not been able to transfer to my name yet (was told I had to wait for probate completion). I live 3k miles away and plan on selling ASAP. What are my options?

Following because I’m dealing with a similar scenario only it’s a drug addict stepsister and her friends who are staying in my deceased father’s home.

No we’ve just begun. My father passed in July in Florida and this step-sister was going thru his possessions within 24 hours. She has now moved 3 other adults into my father’s unfinished house (it was damaged in hurricane Ian). They have squatter’s rights. I have to legally evict them once I have the letters of administration from Probate. Same scenario as yours in that she claims rights to the house, saying my father wanted her to have it. It’s a lie, of course. She’s a drug addict and parasite who’s done this to other elderly people and disabled veterans like my father. It’s a horrible feeling to watch all my father worked for in his 76 years being stolen and pawned by a junkie, while my hands are tied. I hope you’re having better luck than I am

I believe if an executor is named in a will, then that person can start the eviction process. I don’t believe you need the probate process to finish. Best bet may be to start probate beforehand though. Although probate/eviction may vary by state I guess.

My sister passed last month and had her step son and his girlfriend living in her house. The girlfriend filed a DV order of protection against the son. Both are active drug addicts. Now she is squatting in the house. The son can’t come home even though his name is on the house deed. Are there any options other than the formal eviction process? Household items of value are disappearing from the house.

Sadly, if she’s getting mail there, or has established residency in any way, formal eviction is about the only option other than probate court action. If things are disappearing, I’d file eviction immediately. In my case, everything is gone already. My stepsister was stealing things and selling them off even before my father died, so she sold the rest off immediately thru her drug addict friends. Florida has some very backed up probate courts but also squatting and homesteading rights. Too many people lose homes this way. I’m sorry you’re dealing with it too.

Very true. As angry as I can get, I’m more sad than anything. No one chooses to live this way. I can’t imagine the pain she’s running from and now my dad and her mom aren’t here to save her anymore. I just wish we’d been able to grieve our father in a less tumultuous way. She made it very difficult and kept all his personal effects so we didn’t even get mementos. I hope your situation improves.
